Distinguish custody of money, contractual sale deposits and a broker's professional security before transferring funds.

Yacht sale escrow Italy questions concern who receives the money and what allows it to leave their control. Calling a payment escrow does not explain the legal arrangement, the account or the release conditions. Before transferring funds, obtain the proposed custody and sale terms and ask a locally qualified lawyer to assess them together. This guide identifies relevant official legal distinctions without claiming that every yacht purchase follows a single mandatory escrow procedure.
The guide covers custody concepts, permission to use deposited money, sale-deposit consequences and professional security. Practical payment checks are labelled recommendations. No yacht-specific compulsory escrow percentage, standard holding period or verified provider tariff was found in the opened sources. The actual arrangement needs transaction-specific review before the buyer pays. For anything this guide does not cover, email us at info@europeanyachtbrokers.com for the latest information.

Begin with the contract, rather than the account's description. As a practical recommendation, identify the legal holder, the account beneficiary and the written obligations to buyer and seller. Ask a locally qualified lawyer whether the arrangement is custody, an advance paid to the seller, a confirmatory deposit or another contractual structure. The Civil Code provides definitions and consequences for particular arrangements, but this guide does not establish that the word escrow alone selects one of them for a yacht sale.
Ordinary deposit custody is defined by an obligation to safeguard a movable thing and return it in kind. Money can raise a different question when the holder has permission to use it. The Civil Code specifically addresses that case and the obligation to return an equivalent amount. Ask the adviser to explain which legal framework fits the proposed terms. Do not assume that returning an equivalent sum means the exact money has been kept separate or protected against every risk.
Keep the custody agreement and sale agreement consistent. As a recommendation, ask each document to identify the same parties and transaction, then explain how the payment is treated before and after release. A statement that the money is held safely is not a description of the conditions governing it. Ask for the documents before arranging the transfer so the adviser can review the complete arrangement. No universal rule for segregation, insolvency protection or a mandatory bank account type is verified here.
Broker tip: As a practical check, ask a locally qualified lawyer to explain the proposed holder's duties in plain English. Obtain that explanation before transferring money, rather than relying on the account being described as escrow. Ask who is entitled to give instructions and which evidence the holder needs before acting. This is a recommendation for contract review, not a statutory yacht-escrow checklist. The proposed terms should explain how a release is authorised and what happens if buyer and seller disagree. Have the adviser compare those instructions with the purchase conditions and the intended sequence of completion. Avoid a situation where the sale contract describes a condition but the holder's instructions permit an earlier unconditional payment.
The Civil Code's ordinary custody rules address use of the deposited thing and handing it to another holder. They also describe an urgent-circumstances exception for changing the agreed method of custody, with notification. These are legal distinctions to discuss with the adviser, rather than proof that a particular yacht account has special protection. Ask whether the proposed agreement gives permissions that change the arrangement. A broad power to use or move money deserves an explanation before you accept it.
Before making a payment, compare the beneficiary details with the holder identified in the agreed documents. As a practical precaution, independently confirm any changed instructions using contact details already checked, and keep a record of the confirmation. This guide does not present that precaution as an Italian statutory transfer requirement. Ask the adviser and holder to explain how communications, amendments and evidence of receipt will be recorded. Resolve inconsistencies before payment, rather than after the funds have left your account.
Broker tip: As a practical payment precaution, confirm changed beneficiary instructions independently using previously checked contact details. Ask the holder to explain the exact release evidence and how a disputed instruction will be handled before payment. See also our guide on how to transfer boat ownership in Italy.

Section 3
The sale contract's description of the payment matters as much as the person holding it. Italian civil law addresses a confirmatory deposit, called caparra confirmatoria, with consequences for performance and non-performance. Ask a locally qualified lawyer whether the proposed payment has that character and how the custody arrangement interacts with it. Do not describe every advance as automatically refundable or automatically forfeited. The legal assessment needs the actual agreement and the circumstances of any alleged failure to perform.
The verified confirmatory-deposit rule describes what happens when the contract is performed and options where the payer or recipient fails to perform. It also recognises an alternative route of seeking performance or termination with damages governed by the general rules. A disagreement therefore needs more than an instruction from one side saying the money is theirs. As a practical recommendation, ask the custody terms to explain how the holder responds while the parties' rights are disputed and who can authorise release.
No universal yacht deposit percentage, escrow fee or holding period is established by the opened official sources. Obtain actual proposed amounts and charges in writing, identifying who pays them. If the agreement includes survey or other conditions, ask the adviser to explain their interaction with the payment provisions and the release instructions. A worked fee calculation would need verified or expressly quoted inputs; this guide supplies no invented provider tariff or deposit amount simply to make a numerical example. Escrow providers, percentages, holding periods, fees, release procedures, notarial deposit, account segregation and deposit guarantees are not covered here: email us at info@europeanyachtbrokers.com for the latest information.
Broker tip: Have the sale payment clause and custody instructions reviewed together. As a practical check, ask what happens after performance, failure of a sale condition and a disputed allegation of non-performance before you commit funds. A maritime mediator's professional security is separate from the money paid for a yacht. Official chamber guidance describes security for obligations arising from the professional activity. It does not describe that security as a purchase-price escrow account. Do not infer that the whole amount you transfer is protected merely because the intermediary has supplied registration evidence. Ask the adviser to assess the actual holder, custody contract and payment arrangements independently of the professional registration check before you decide to pay.
The Civil Code permits a mediator to provide a personal guarantee, called fideiussione. That permission is not a statement that every mediator has guaranteed every transaction. If a guarantee is offered, ask for the document and obtain a locally qualified explanation of the obligation and its scope. This guide does not promise recovery from a broker or bank without assessing an actual guarantee. A reference to professional security should not be treated as interchangeable with a contractual undertaking to repay purchase money.
Ask what evidence you will receive after the holder acknowledges the funds and after they are released. This is a practical recommendation for preserving the payment record, not a compulsory Italian completion form asserted here. Keep the signed terms, instructions and acknowledgements with the sale documents. If the proposed arrangement relies on notarial, banking or cross-border protection, request a specific official or contractual basis from the adviser. Those arrangements were not independently established for yacht purchases by the sources used in this pack.
Broker tip: Keep registration, professional security, custody and any personal guarantee as separate checks. Ask a locally qualified adviser to identify which document actually protects your payment and what its terms require before funds are released. Your questions
No protection is established by the label alone in this guide. The actual holder, contract and permissions need review. The Civil Code distinguishes ordinary custody from a money deposit where the holder is allowed to use the funds and returns an equivalent amount. Ask a locally qualified lawyer to identify the arrangement and assess its protections before transferring the payment. (Normattiva – Civil Code Article 1782)
The ordinary custody rule prohibits use or redeposit without the depositor's consent. It separately allows a different custody method where urgent circumstances require it, with notice as soon as possible. Ask the adviser whether those rules fit the proposed arrangement and which permissions the contract gives. Do not assume that a yacht payment has particular custody protection without reviewing its actual terms. (Normattiva – Civil Code Article 1770)
No automatic refund for every withdrawal follows from the confirmatory-deposit rule. It provides different consequences for performance and non-performance, including retention where the payer fails to perform and the other party withdraws. Ask a locally qualified lawyer to assess the actual payment clause and sale conditions. A custody holder's instructions also need to explain how disputed release requests are handled. (Normattiva – Civil Code Article 1385)
Whole-purchase-price cover is not established by the chamber guidance. It describes professional security for obligations arising from maritime mediation, rather than a yacht-purchase escrow account. Ask a locally qualified adviser to review the actual payment holder and custody terms separately. A register entry and professional security do not explain when your money can be released or what happens to a disputed payment. (Riviere di Liguria Chamber of Commerce)
No automatic personal guarantee is established by the Civil Code provision. It permits a mediator to provide a guarantee for a party, so an offered guarantee needs its own document and explanation. Ask a locally qualified adviser to assess the obligation and scope before relying on it. Keep that review distinct from the broker's professional registration and from the terms governing custody of your money. (Normattiva – Civil Code Article 1763)
