Understand the maritime broker's official registration route, qualifications and the limits of what a register entry tells you.

Yacht broker regulation Italy questions start with the actual activity and the business undertaking it. A yacht advertisement does not establish the person behind it has met the requirements for professional maritime mediation. Official chamber guidance describes a specific registration route for that activity, with qualifications and a commencement notification. Before appointing someone, identify the business and the person who will handle your sale or purchase, then ask the competent chamber how to verify the relevant position.
This guide explains the official maritime-mediation framework and practical checks for buyers and sellers. It covers qualifications, filing, business locations and statutory security. It distinguishes those requirements from transaction guarantees. It does not claim that a register entry proves ownership of a yacht or protects every payment made during a purchase. Normattiva – Civil Code Article 1759, updated 19 Apr 1942 ·Section 1
The chamber describes professional maritime mediation in contracts involving construction, sale, lease and hire of ships and maritime transport of goods. Its guidance refers to the specific maritime profession law and later changes to the register system. Ask the competent chamber to confirm how the business's actual activity fits the framework. This is a recommended check where a business uses several commercial descriptions. Do not assume that a general claim to work in marine services answers the maritime-mediation registration question.
The former ordinary section of the maritime mediators' role was abolished, but the qualification requirements were not removed. Current chamber guidance explains the business-register route that replaced it. A buyer should therefore ask about the current position rather than insisting on an outdated ordinary-role certificate as the only evidence. If an old registration is offered as proof of qualification, ask the chamber how that professional qualification relates to the present business and the person now undertaking the transaction.
The special section has a separate purpose involving public offices, including presiding over public tenders. It is not presented by the chamber as a requirement that every private yacht buyer must demand. Keep the question tied to the service you are buying. As a practical recommendation, provide the chamber with the exact business name and a description of the proposed role, then retain its explanation. This guide does not assess the classification of every foreign business or cross-border arrangement.
Broker tip: As a practical verification step, ask the competent chamber about the exact activity and business involved. Use the current register route described by the chamber rather than relying on an advertisement or an unexplained historical certificate. Section 2
Professional commencement is linked to a certified notification of starting the activity, called segnalazione certificata di inizio attività, or SCIA. The chamber's guidance ties the start date to submission of that notification. As a practical check, ask the business which chamber holds its position and which legal entity is undertaking your appointment. Match those details to the agreement and invoice. The guide does not describe an incomplete filing as sufficient evidence simply because a business has begun advertising.
Qualification checks concern the people undertaking the activity, as well as the business name. Riviere di Liguria's guidance identifies the sole trader and the legal representatives of a company. It also requires a suitably qualified person at each site or local unit where the business operates. Ask who will actually handle your transaction and how that person relates to the registered business. This is a recommended verification question, not an assumption that everyone appearing in a marketing photograph performs regulated mediation.
The official guidance also identifies an educational qualification and the professional examination route. Those requirements should not be replaced by a statement about experience alone. Ask the chamber which evidence establishes the relevant qualification in the specific case, including a former ordinary-role qualification where applicable. Avoid demanding unrelated certificates that the opened guidance does not mention. Cross-border temporary services and other exceptional routes are not verified in this pack, so those cases need a separate official answer before you draw a conclusion.
Broker tip: Ask for the legal business name, competent chamber and identity of the person handling your transaction before signing. Match those details across the appointment, communications and invoice as a practical consistency check. Our guide on how much yacht broker commission is in Italy covers a related point.

Section 3
The statutory security described by the chamber is a professional obligation, not the purchase deposit you might pay for a yacht. The guidance specifies a security amount and permitted forms. Read those facts in their actual context. This guide does not claim that the security creates a separate safeguarded account for a buyer or reimburses the whole purchase price. Before sending money, obtain separate advice about the payment arrangement and its contractual protections rather than relying on the broker's regulatory position alone.
The qualification route also has a stated period within which an examination candidate can begin the activity. That is a professional commencement rule, not a promised waiting time for a buyer's transaction. Where a business points to an examination result, ask the chamber to confirm its current relevance to the person and registered position. Do not apply a rule for new examination candidates indiscriminately to a former ordinary-role qualification that the same guidance describes as permanently qualifying for commencement.
Ongoing changes matter when the person handling your transaction or the company's representatives change. Rome's guidance requires particular changes affecting qualification checks to be reported and describes filings for multiple locations. Ask for the current position if you are shown old business information. This is a practical recommendation to keep the identity check current. No universal fee for obtaining register evidence or completing a yacht transaction has been verified here, and no standard brokerage appointment cost is inferred from the professional security. Cross-border services, classification of small craft, register-extract fees, complaint times and disciplinary outcomes are not covered here: email us at info@europeanyachtbrokers.com for the latest information.
Broker tip: Treat professional security and your purchase payment as separate questions. Ask a locally qualified adviser to explain the actual deposit protections before transferring funds, even where the business has supplied satisfactory registration evidence. A related question is answered in our guide on whether to use a yacht broker or a dealer in Italy.

Registration answers a professional-status question. It does not by itself answer who owns the yacht, what the sale contract says or how a buyer's money will be handled. Keep those transaction checks separate. As a practical recommendation, ask who is responsible for checking ownership documents, approving sale terms and arranging any deposit. This guide makes no claim that the chamber certifies every yacht offered by a registered business. The official registration guidance describes the intermediary's position, rather than a boat-specific approval.
The Civil Code supplies a separate duty concerning known information. A mediator must communicate known circumstances relating to valuation and security of the transaction that can affect its conclusion. Ask questions about the information supplied and keep the answers with the transaction file. This verified duty should not be represented as a guarantee that every hidden fault has been found. A technical inspection and transaction-specific legal review need their own instructions where the buyer or seller wants those services.
The chamber guidance also describes restrictions on other employment and the reporting of cessation. Those are reasons to obtain current information rather than rely indefinitely on a past appointment. If the business identity or person undertaking the work does not match the evidence supplied, ask the chamber for clarification before proceeding. This is a recommended response to a discrepancy. No complaint outcome, disciplinary timetable or recovery guarantee is established by the sources used here, so none is promised to the reader.
Broker tip: Check the professional position and the yacht transaction separately. If names or roles differ between the evidence and the appointment, ask the chamber to clarify the discrepancy before treating the registration check as complete. Your questions
The current position should be checked through the business-register route described by the chamber. The ordinary role was abolished without removing the underlying qualification requirements, and former ordinary-role registration remains a recognised professional qualification in the guidance. Ask the competent chamber how the evidence supplied relates to the present business and person handling your transaction, rather than relying on an obsolete register description alone. (Riviere di Liguria Chamber of Commerce)
The chamber ties the commencement date to submission of the certified commencement notification, SCIA. That notification declares the required qualifications; it is not an excuse to ignore them. Ask which chamber holds the business position and match the legal entity to your appointment. This guide does not treat an incomplete filing or advertising activity as conclusive evidence that the requirements have been satisfied. (Riviere di Liguria Chamber of Commerce)
No whole-payment protection is established by the chamber guidance. It describes professional security for obligations arising from the activity, not a yacht-purchase escrow arrangement or a guarantee of the purchase price. Keep the payment question separate and obtain locally qualified advice on the actual holder, account and release terms before transferring money. Registration evidence does not settle those transaction-specific protections. (Riviere di Liguria Chamber of Commerce)
Yes; the chamber requires at least one suitably qualified person acting for the business at each site or local unit where the activity is carried out. It also identifies qualifications for the sole trader or company legal representatives. Ask who will actually handle your transaction and how that person relates to the business position, rather than checking only the trading name displayed in an advertisement. (Riviere di Liguria Chamber of Commerce)
No unlimited hidden-defect guarantee is established here. The Civil Code requires communication of known circumstances concerning valuation and security that can affect conclusion of the transaction. Keep that duty distinct from technical inspection instructions and legal review of the particular sale. As a practical recommendation, record the questions asked and the answers supplied so the transaction file shows what information was communicated. (Normattiva – Civil Code Article 1759)
No. This guide does not treat registration as escrow or deposit protection. Email us at info@europeanyachtbrokers.com for the latest information, and ask a locally qualified lawyer how to protect any payment.
