Do You Pay VAT on a Boat in Croatia? 2027 Guide

Separate the boat's VAT classification from its registration, flag and customs status before committing to a transaction.

By Peter Mattey · 9 min read · Facts checked 2026-10-03

Boat VAT Croatia needs a transaction-specific answer, not a label copied from the sales advert. As a practical recommendation, identify the seller's status, where the boat moves and whether the special new-means-of-transport rules apply before agreeing the tax wording in the contract. Ask for the evidence behind any claim about previous VAT, and keep that question separate from whether the vessel has Union customs status.

Croatian Customs publishes detailed guidance on new means of transport, including maritime thresholds and declaration requirements. The Tax Administration explains the broader VAT scope, while the government tax-system page identifies the general rate. This guide presents those verified rules with their stated conditions and avoids treating a rate or an old invoice as a complete tax decision. For anything this guide does not cover, email us at info@europeanyachtbrokers.com for the latest information.

Section 1

Establish the transaction before applying the general rate

The government tax-system page identifies 25% as Croatia's general VAT rate and references the VAT Act through its stated 2026 amendments. As a practical recommendation, establish whether and how the proposed transaction is taxable before applying that rate to the advertised price. Ask the seller to specify the invoice treatment and have a qualified adviser examine it where needed. A published general rate is useful evidence, but it does not establish that every private resale, import or business transaction has the same tax calculation.

The Tax Administration's VAT overview lists domestic supplies for consideration by a taxable person acting as such, intra-EU acquisitions and imports among its taxable categories. It also identifies persons independently conducting an economic activity and persons making occasional supplies of new means of transport. As a practical recommendation, describe the seller and buyer accurately when asking for tax advice. The fact that someone calls themselves a private owner does not answer the special cross-border new-transport question or every possible business-use issue.

As a practical recommendation, request a written explanation of the proposed VAT basis and retain it with the sale papers. Distinguish a price described as inclusive of VAT from documentary proof of how the transaction is taxed. Ask whether the seller acts as owner, business supplier or intermediary and identify the actual supplier on the invoice. This guide does not assert a universal exemption for used privately advertised boats, nor does it manufacture a reduced rate from a rule applying to a different nautical service.

Broker tip: As a practical recommendation, ask for the actual tax basis in writing before agreeing the price. Give a qualified adviser the seller's status, boat history and planned movement rather than requesting a rate in isolation. Our guide on how to import a boat into Croatia covers a related point.

Section 2

Apply the new-means-of-transport tests correctly

Customs' maritime definition covers qualifying vessels longer than 7.5 metres, with exclusions for the stated sea-going passenger, commercial, industrial, fishing, rescue and assistance uses. As a practical recommendation, check that the vessel falls within the relevant category before applying the new-transport tests. The commercial exclusions need their actual conditions considered; a seller's intention to charter the boat is not itself a tax ruling. Ask Customs or a qualified adviser to assess the proposed use and the source's full wording where an exclusion may matter.

For a vessel within that definition, the published tests are alternatives: delivery within three months of first use, or no more than 100 sailing hours. As a practical recommendation, obtain evidence of both first use and time sailed. Do not replace sailing hours with a casually reported engine-hour figure without checking what it establishes. A vessel described as used in a sales advert can still meet one of the tax tests. Conversely, this definition should not be expanded into a claim that every newly purchased boat is new for VAT.

The Customs guidance explains that first use can involve registration and the stated alternative events, including delivery to the first buyer or first being made available for use. It applies destination taxation to the intra-EU acquisition of qualifying new means of transport where dispatch or transport to the acquirer ends. As a practical recommendation, record the movement and delivery plan accurately and obtain advice on its tax effect before signing. Do not assume an invoice from another member state necessarily settles the destination country's obligation.

Broker tip: As a practical recommendation, collect first-use evidence and sailing-time records separately. Ask Customs to check any claimed maritime exclusion and the destination treatment before treating the seller's description of age as a tax answer. Section 3

Prepare declarations and the appropriate payment evidence

Customs states that the acquirer of a qualifying new means of transport within the EU is liable for VAT regardless of whether registered for VAT. Its instructions distinguish people outside the VAT register from registered taxable persons when describing payment and reporting. As a practical recommendation, tell Customs your actual tax status rather than assuming the same filing sequence applies to everyone. Ask which office and form should be used and retain the response with the transaction evidence so that your submission can be prepared accurately.

For an acquirer not registered for VAT or without a VAT identification number, the page gives a ten-day acquisition declaration period and a payment deadline no later than ten days from the acquisition, invoice or contract date as described. It uses the Stjecanje NPS form. As a practical recommendation, have the relevant office confirm the event that starts the period in your transaction before completion. This is a sourced deadline with a specified scope, not an invented estimate of how quickly a boat purchase or registration normally finishes.

The guidance requires a copy of the invoice or purchase contract and, if available, the transport asset's registration document with the acquisition declaration. It distinguishes the confirmed payment decision for non-VAT-registered acquirers from the acquisition declaration certificate supplied to VAT-registered acquirers for registration purposes. As a practical recommendation, ask which evidence your registrar will expect and allocate responsibility for obtaining it. A bank-transfer receipt and an authority-issued decision are different documents; do not assume one fulfils the other's stated role. No purchase-specific VAT determination, invoice review, exemption assessment or import calculation was obtained. No universal private-resale exemption, reduced boat-purchase rate or automatic input-tax deduction is asserted. For these, email us at info@europeanyachtbrokers.com for the latest information.

Broker tip: As a practical recommendation, confirm your reporting route before delivery and keep authority-issued evidence with the purchase file. Ask which event starts the deadline and which document the registrar requires for your tax status. See also our guide on how to buy a boat in Croatia.

Section 4

Keep VAT evidence distinct from customs status

Customs explicitly states that ownership, an EU registration and the flag flown do not establish Union customs status. As a practical recommendation, ask for separate evidence rather than accepting registration papers as the answer to both questions. Its leisure-craft guidance identifies T2L and an invoice meeting specified conditions as proof routes. A historic invoice may be relevant to a VAT enquiry, but the customs page does not say that any invoice automatically proves the vessel's status. Have the actual document and vessel identifiers checked together.

The invoice route has stated documentary requirements, including the relevant identity, goods-description and T2L particulars. As a practical recommendation, ask Customs whether the papers provided meet the route for this boat and transaction instead of copying a checklist without context. This guide does not claim that an invoice marked VAT paid is a universal customs passport. Keep the official customs evidence, purchase invoice and any new-transport declaration separately labelled so that a future adviser can see which question each document is intended to address.

For non-Union craft, the leisure-craft page also describes temporary admission under specified establishment, registration and use conditions. As a practical recommendation, disclose any existing temporary-admission procedure before completing a sale or changing the vessel's use. Obtain advice from Customs or a qualified adviser on the consequences for the proposed buyer. A previous owner's procedure is not evidence that a different buyer automatically qualifies. This guide does not calculate an import bill or assume that a proposed transaction can continue under the earlier arrangement.

Broker tip: As a practical recommendation, retain separate folders for VAT treatment, customs status and registration. Refer any proposed sale involving temporary admission to Customs before assuming the new owner can use the previous procedure. Your questions

Frequently asked questions

Is every boat sale subject to 25% VAT?

The verified source identifies 25% as the general rate, not a finding that every transfer is taxable. The transaction's scope, parties and any applicable special rules must be established first. As a practical recommendation, ask for the invoice treatment in writing and obtain qualified advice where the proposed sale, business status or cross-border movement leaves the answer uncertain. (Croatian government investment portal — tax system)

Must a boat meet both new-transport tests?

No: the published maritime tests are alternatives for a vessel within the qualifying definition. Delivery within three months of first use OR no more than 100 sailing hours can make it new for those VAT rules. As a practical recommendation, collect reliable evidence for both dates and sailing time, rather than treating a used-boat advert as a tax classification. (Croatian Customs — VAT on new means of transport)

Does buying privately remove the intra-EU new-boat obligation?

No: Customs states that the acquirer of a qualifying intra-EU new means of transport is liable regardless of VAT registration. Its guidance also addresses occasional suppliers of new means of transport. As a practical recommendation, have the actual vessel and movement assessed before relying on the seller's private status as a reason to ignore the special destination rules. (Croatian Customs — VAT on new means of transport)

Which papers accompany the acquisition declaration?

Customs lists a copy of the invoice or purchase contract and, if available, a copy of the registration document. It distinguishes the later authority-issued evidence according to the acquirer's VAT status. As a practical recommendation, confirm your own reporting route and the registrar's expected document before completion, and keep the declaration and authority's response together in the purchase file. (Croatian Customs — VAT on new means of transport)

Does an EU flag prove that the boat has Union customs status?

No: Customs expressly says that flag, ownership and EU registration do not prove that status. The leisure-craft page identifies separate evidence routes such as T2L and a qualifying invoice meeting its conditions. As a practical recommendation, ask Customs or a qualified adviser to check the actual documents rather than treating nationality as a substitute for customs evidence. (Croatian Customs — leisure craft)
