THE EYB COUNTRY GUIDES · Spain
Separate preparation expenditure, delivery costs, official charges and the buyer's transfer-tax responsibilities.
By Peter Mattey · 9 min read · Facts checked 2026-10-03
Boat selling costs Spain should be calculated from your actual obligations rather than a guessed percentage of the asking price. Preparation work, service engagements, delivery arrangements and official charges can involve different payers. This guide explains verified Spanish rules on those allocations and transfer-tax treatment while keeping practical budgeting recommendations separate. It supplies no invented broker commission, notarial price, yard charge or tax rate, and it does not promise a common cost for every boat sale.
The guide is for sellers preparing a budget and buyers checking which charges belong to them. It helps organise quotations and payment evidence, distinguish professional fees from official charges and identify tax questions for a qualified adviser. The boat's registration and the actual transaction determine the relevant administrative route. Our recommendation is to separate preparation expenditure, agreed transaction charges and continuing ownership costs before deciding what offer you can accept. Obtain quotations for the cleaning, photography, repairs, storage or other work you actually want. Ask each supplier what is included and who will receive the invoice. Do not turn a percentage remembered from another sale into a budget for this boat. No verified national average for privately commissioned marketing or preparation services was obtained for this guide, and no estimate is supplied as fact.
If you appoint a broker or another service provider, our recommendation is to agree scope, payment triggers and separately reimbursable expenses in writing. Ask how cancellation of the instruction affects authorised expenditure and what tax treatment is included in the quotation. This guide does not assert an official brokerage percentage or that every broker follows an identical charging method. Keep the broker's engagement separate from the boat sale contract, so a fee for a service is not confused with a buyer's obligation to pay the purchase price.
Our recommendation is to keep a running list of confirmed and unresolved costs while the boat remains yours. Put the actual marina, storage and maintenance arrangements beside that list and ask suppliers to identify the end of your obligation. An anticipated completion date should not replace the cancellation or billing conditions in a separate contract. When comparing offers, calculate the proceeds using your own verified liabilities. An apparently higher price can be difficult to assess if one proposal leaves responsibility for work or charges unresolved.
Broker tip: Our recommendation is to give each budget line a named supplier, a written quote, a payment trigger and an agreed payer, keeping unconfirmed amounts visible rather than hidden in a guessed allowance. Readers often go on to our guide on how much yacht broker commission is in Spain.

Section 2
The Spanish Civil Code, Código Civil, gives a default allocation for costs of executing a public deed and for its first copy and later sale expenses, unless the parties agree otherwise. Our recommendation is to ask the adviser whether a public deed is part of this transaction and to identify the actual charges. Do not treat a legal allocation rule as a quoted notarial price. A private agreement and a document suitable for a public register involve distinct questions that need review for the actual boat.
The Civil Code also distinguishes expenses of delivery from transport or moving the item, with allowance for a special agreement. Our recommendation is to identify the place of handover and the movement the buyer intends to arrange afterwards. Ask who authorises any yard services or repositioning needed for the agreed delivery. Avoid a completion statement that describes every movement as the same service. Clear instructions let the supplier and parties identify the work and the payer without relying on an assumed customary allocation.
The Maritime Navigation Law, Ley de Navegación Marítima, provides a default for the risk of loss or deterioration before and after delivery, with application to boats where their nature permits. Our recommendation is to align the agreed handover with the insurance and service arrangements and have the lawyer review any departure from the default. The rule concerns risk allocation; it does not establish a premium, delivery-service price or automatic insurance transfer. Keep those separately quoted matters distinct from the legal point at which risk changes.
Broker tip: Our recommendation is to name the handover location and distinguish delivery work from subsequent transport in the agreement, then check those instructions against the quotations and insurance arrangements. Our guide on boat valuation in Spain covers a related point.

Section 3
For recreational craft governed by Royal Decree 1435/2010, renewal or new issue of the Spanish registration certificate and navigation permission involves the fees for annotation and issue and delivery of the certificate. Our recommendation is to request the actual amount from the administration or person handling the application rather than copying an old tariff. The legal description of the charge does not establish every provider's price for assisting with the file. Ask for official charges and professional services to appear as separate lines.
The ministry's current recreational-craft form includes proof of payment of the applicable fee and identifies its payment model. Our recommendation is to confirm the precise administrative action being requested before generating a payment. A transfer, a change of name and another amendment should not be bundled into an unexplained amount. Retain the payment record with the filing. This guide does not provide a current euro figure because the applicable official charge for the individual transaction was not verified, and no outdated amount is used as a substitute.
Our recommendation is to ask the person handling the file to state which payments are yours, which are the buyer's and when each must be made. If an adviser pays a charge for you, obtain the administration's payment evidence alongside their own invoice. Reconcile the completion figures before treating the sale receipt as disposable proceeds. A worked fee total would require actual verified inputs; this guide supplies none rather than inventing typical amounts to make the arithmetic appear more complete than the evidence. No official fixed brokerage percentage, private service average or current euro tariff for the individual administrative action was verified. The first section is practical budgeting advice and contains no official fact objects; the allocation and administrative sections contain fewer than four rather than unrelated quota padding. For these, email us at info@europeanyachtbrokers.com for the latest information.
Broker tip: Our recommendation is to ask for the official payment receipt and the service provider's invoice separately, then compare both with the agreed completion statement before releasing any reimbursement. A related question is answered in our guide on whether you pay VAT on a boat in Spain.

Certificate issue charges
Article 17.4 of Royal Decree 1435/2010 limits renewal or new certificate issue charges to the fees for the record annotation and issue and delivery of the certificate. BOE consolidated version published 6 November 2010; effective 1 January 2011.

Transfer tax, Impuesto sobre Transmisiones Patrimoniales, needs to be considered separately from the seller's marketing expenditure. Its consolidated statute identifies the acquirer as taxpayer for a transfer of goods or rights, irrespective of a contrary agreement between the parties. Our recommendation is to ask the tax adviser to identify the applicable transaction and administering authority before agreeing a tax figure. A contractual reimbursement arrangement should not be described as changing the person whom the tax law names as taxpayer.
The transfer-tax statute distinguishes certain business or professional transactions and supplies outside its onerous-transfer category. It also provides a general market-value basis, with a higher declared value or agreed consideration taking precedence where applicable. Our recommendation is to obtain the actual assessment for the boat and transaction rather than assuming the advertised price always answers the tax question. No regional transfer-tax rate, exemption or deadline is claimed here without a verified applicable source. Keep the classification question separate from the calculation.
The ministry's transfer form lists proof relating to transfer tax, inheritance and gift tax or VAT, according to the case. Our recommendation is to let the adviser identify which evidence belongs in the actual file and retain it with the transfer document. The seller's own income-tax position and any cross-border issues also need individual review. No private-versus-company shortcut, automatic exemption or fixed net-proceeds deduction is supplied in this guide; those claims would require more evidence than the transaction-allocation rules opened here provide.
Broker tip: Our recommendation is to ask the tax adviser to identify the taxpayer, applicable treatment and required evidence in writing before completing the figures, rather than relying on a description in an advert. Your questions
The Civil Code places execution expenses of the deed on the seller and the first copy and later sale expenses on the buyer, unless agreed otherwise. Our recommendation is to ask whether a public deed is part of the actual transaction and request the quoted charges separately. The allocation rule should not be presented as a fixed notarial tariff. (BOE)
The Civil Code distinguishes delivery expenses, allocated to the seller, from transport or movement expenses, allocated to the buyer, unless specially agreed otherwise. Our recommendation is to identify the handover location and the work commissioned for delivery separately from later movement. Match that wording to the supplier quotations so the parties are not discussing different services under the same heading. (BOE)
The official rules do not establish that a private quotation combines those amounts. Our recommendation is to request official registration charges and professional fees separately. Royal Decree 1435/2010 identifies charges connected with annotation and issue of a new certificate, while the ministry form lists fee-payment evidence. Retain the administration's receipt alongside any invoice for assistance. (BOE; Ministerio de Transportes y Movilidad Sostenible)
The acquirer is the taxpayer under Article 8(a) of Royal Legislative Decree 1/1993, irrespective of a contrary agreement between the parties. Our recommendation is to ask a qualified adviser to establish the applicable transaction and tax treatment before calculating the amount. A contractual arrangement concerning reimbursement should not be described as changing the statutory taxpayer. (BOE)
No verified standard percentage is supplied here. Our recommendation is to use written quotations, actual continuing obligations and the contract's allocation of charges. The official sources distinguish expense responsibilities, registration charges and tax treatment rather than establishing a universal seller's deduction. Keep unresolved figures separate until the provider or adviser confirms the amount applicable to your own transaction. (BOE)
This guide only includes facts checked against official sources. For anything it does not cover, email us at info@europeanyachtbrokers.com for the latest information, and ask a locally qualified adviser to confirm the position for your own boat.
