Are Yacht Brokers Regulated in Croatia? 2027 Checks

Check business identity, brokerage duties, money authority and official complaint routes when using a Croatian yacht broker.

By Peter Mattey · 9 min read · Facts checked 2026-10-03

Yacht broker regulation Croatia should be considered through the actual business identity, the brokerage obligations and the authority given in the transaction. Official sources explain the company register, conduct duties, handling of another-party instructions and consumer service complaints. They do not establish a dedicated yacht broker licensing scheme in the material reviewed. Buyers and sellers should ask for evidence of any specific authorisation or client-money safeguard claimed by the business before relying on it.

This guide covers official company checks, conduct standards, payment authority and dispute routes. It distinguishes those verified rules from unverified claims about specialist licensing or escrow guarantees. A locally qualified lawyer should review the actual appointment, any separate money authority and disputed conduct, particularly in an international yacht transaction. For anything this guide does not cover, email us at info@europeanyachtbrokers.com for the latest information.

Section 1

Verify the brokerage business and representatives

The Ministry describes the Court Register as a public book containing authoritative and current information and documents for registered entities. Commercial courts maintain it. A normal extract contains information valid on its issue date, while a historical extract shows recorded data from establishment to issue. These are useful business-identity checks before an appointment. They do not themselves establish a yacht-specific professional licence, confirm a payment account's safeguards or resolve the legal authority given for an individual boat transaction.

Our recommendation is to compare the legal entity in the proposed appointment with the current register information and the invoice details. If the trading name differs, ask for a written explanation connecting it to the contracting business. Obtain a current extract when the transaction is ready to proceed rather than relying solely on an old marketing brochure. Where a company's name or structure has changed, a historical extract can help explain the documented sequence and identify which entity undertook the work.

Keep business identification separate from the boat's title investigation. A legitimate registered company can still be an intermediary acting for a private owner, and its register entry does not show that it owns the advertised yacht. Ask which party is selling, who will sign and what authority the intermediary holds. Preserve the company extract and appointment together so the transaction file identifies the business involved. Any yacht-specific authorisation claimed by the broker should be supported by the actual official instrument.

Broker tip: Check the legal entity at appointment and again before payment. Keep the current extract with the contract and ask for evidence connecting any trading name to the business that is actually providing the service. Section 2

Understand the broker's conduct duties

The Civil Obligations Act requires businesslike care in seeking a contracting opportunity and communicating it to the principal. Significant circumstances known or reasonably knowable must be disclosed. It addresses liability for culpable damage, including specified known incapacity or inability of a counterparty to perform. It also imposes liability for damage caused by unauthorised disclosure of instructions, negotiations or concluded terms. These are verified brokerage duties, rather than evidence of a separate yacht broker licensing or disciplinary system.

Ask the broker how material information, offers and instructions will be recorded and sent to you. Our recommendation is to require supporting documents for significant claims and to give disclosure permissions explicitly. A technical problem, an apparent authority issue or a counterparty concern should be recorded in the transaction file and considered before further commitment. Do not replace independent inspection or local legal review with an assurance that the broker's business registration guarantees every aspect of the proposed purchase.

If something goes wrong, identify the alleged failure and the evidence connecting it to the claimed loss. An unsuccessful marketing period alone does not establish that a particular duty was breached. Keep instructions, disclosures, reports and the sale chronology so local advice can assess what the broker knew, should have known or was authorised to disclose. The guide does not determine negligence or award compensation; it explains the official duties that are relevant to reviewing the service provided.

Broker tip: Record significant claims and disclosure permissions in writing. Keep the supporting evidence, because a useful service review needs the actual instructions and information available rather than a general complaint that the transaction failed. Section 3

Check money authority and both-party instructions

A brokerage instruction does not itself authorise receipt of contractual performance for the principal; the Act requires special written authority. Where both parties instruct the broker, the default fee allocation is half the commission and half agreed expenses from each unless otherwise agreed. The broker must care for both parties' interests in that arrangement. Working for the other party contrary to the contract or the principal's interests removes commission and expense rights. Authority, disclosure and fee allocation therefore need separate attention.

Before paying a deposit or sale balance, ask who receives it, in what capacity and under which written authority. Our recommendation is to review the proposed release instructions with independent local advice and confirm payment details through an independently checked channel. A company-register entry is useful identification evidence but is not proof of escrow protection. If the broker also acts for the other party, obtain a clear explanation of that appointment and how the parties' interests and payments will be handled.

A transaction can become confused when the same business advertises the yacht, helps negotiate and asks to receive the money. Those activities do not establish identical legal powers. Keep the appointment, additional written authority and payment arrangement together, and ask for clarification where the named recipient differs. The guide does not verify a national yacht broker client-money guarantee or compulsory escrow scheme. Treat a specific claim about safeguarded funds as a matter requiring its own official and contractual evidence before payment. No dedicated yacht broker licence, disciplinary regulator, compulsory professional-indemnity cover or national client-money guarantee verified. A register entry does not establish ownership of a particular yacht or the scope of a broker's transaction authority. For these, email us at info@europeanyachtbrokers.com for the latest information.

Broker tip: Confirm the recipient's role and written authority before transferring funds. Ask separately about any appointment for the other party, and have the proposed custody and release arrangement assessed before you rely on a safeguards claim. Section 4

Use the appropriate service-dispute route

For a consumer's service complaint, the Ministry portal allows a written submission to the trader in person, by post or electronically. It gives the trader fifteen days after receipt to answer. Where the dispute remains unresolved, it identifies alternative dispute-resolution bodies as a possible route, and the competent court where an amicable solution cannot be reached. Those routes concern consumer service disputes; they do not establish a specialist yacht broker regulator or guarantee that every boat owner has consumer status.

Our recommendation is to identify the contracting business and describe the disputed conduct or charge precisely. Attach the appointment, instructions, invoice and relevant correspondence rather than sending the entire transaction history without explanation. Keep evidence that the trader received the complaint and preserve its response. If you are acting for a business, obtain advice about the appropriate contractual dispute route instead of assuming the consumer procedure applies. The underlying obligations and the complaint procedure answer different questions.

When a reply does not resolve the matter, consider a suitable alternative dispute-resolution body or ask local advice about proceedings before the competent court. The evidence should show the promised service, the authority given and the alleged failure. Do not describe a business-identity check as regulatory approval of the sale or treat a complaint submission as an order requiring a refund. The guide does not verify a dedicated yacht broker disciplinary body, compulsory professional insurance or a national client-money compensation scheme.

Broker tip: Keep a concise written account of the disputed service and the remedy you seek. Preserve the delivery record and reply so the next adviser or dispute body can assess the same documented issue. See also our guide on how yacht sale escrow works in Croatia.

Your questions

Frequently asked questions

Does a company-register entry prove yacht broker licensing?

The Court Register helps identify a registered entity and obtain current or historical information. The official material reviewed does not establish that such an entry is a yacht-specific professional licence. Ask the broker for the exact official authorisation if it claims one, and review its appointment separately. Business identity, ownership of the advertised boat and authority to act in the particular transaction require different evidence. [Ministry of Justice]

What conduct duties are verified?

The Act requires businesslike care in seeking an opportunity and disclosure of significant circumstances known or reasonably knowable. It also addresses culpable counterparty risks and damage from unauthorised disclosure of instructions, negotiations or agreed terms. Keep the promised service and material information in writing. Those duties are not proof that the broker has performed an independent technical inspection or completed every legal check for the yacht. [Narodne novine]

Can the broker receive my payment automatically?

No. A brokerage instruction does not itself authorise receipt of the principal's contractual performance; special written authority is required. Confirm the proposed recipient, capacity and release arrangement before payment and obtain independent local advice where needed. A registered business identity does not by itself verify escrow protection, a client-money guarantee or the authority given for that particular transaction. [Narodne novine; Ministry of Justice]

Can the broker act for both parties?

The Act addresses instructions from both parties and requires care for both parties' interests. Unless otherwise agreed, its default allocation is half the commission and half agreed expenses from each. Work for the other party contrary to the appointment or principal's interests can remove commission and expense rights. Require clear disclosure and retain the actual appointments and fee arrangements before relying on the broker's role. [Narodne novine]

Is there a verified specialist yacht broker complaints body?

No dedicated yacht broker disciplinary body was verified in the material reviewed. The Ministry consumer portal describes written complaints to a service trader, a fifteen-day reply period, alternative dispute resolution and the competent court where amicable resolution fails. Confirm your consumer status and obtain advice about the appropriate route for the actual dispute. These procedures do not guarantee compensation or establish specialist professional licensing. [Ministry of Economy]
