Can You Sell a Boat Privately in France? 2027 Guide

Organise your own marketing and completion while keeping ownership evidence, condition questions and maritime formalities clear.

By Peter Mattey · 9 min read · Facts checked 2026-10-03

Sell a boat privately France planning means taking responsibility for the organisation of marketing, enquiries, inspection and completion. You can arrange those tasks yourself while still obtaining qualified legal, tax and technical advice for the questions that need it. The yacht's documents and actual condition should support the description, and the signed sale needs the applicable maritime formalities. This guide combines verified official requirements with practical recommendations, without inventing a compulsory broker appointment or promising that private selling removes every professional cost.

The sources do not establish a standard private-sale discount, timetable or mandatory photo package. Organisation and inspection suggestions are practical advice. Confirm current requirements with the relevant authority or a qualified adviser, especially where several owners, a mortgage, import history, a different flag or a conditional agreement complicates completion. Prepare your own ownership and technical document file

The Ministry's ownership-transfer checklist includes an invoice or sale document signed by all parties identifying the yacht and parties, with the existing registration certificate and relevant owner records. As practical advice, establish every owner's involvement before arranging a signing appointment. Keep a copy of the current title and ownership history ready for review, and ask the adviser to resolve authority questions before presenting the boat as ready for straightforward completion. The person arranging a viewing should not be treated as authorised to sell every interest without checking the actual arrangement.

The Ministry separately recommends investigating the yacht's mortgage position with the competent commercial court before purchase. As practical advice, help the adviser obtain the relevant documentary evidence so that a serious buyer's enquiry can be answered accurately. The official first-registration checklist also distinguishes a fiscal certificate for boats longer than 7.5 metres bought in another EU country from an import declaration for third-country purchases. Retain the relevant acquisition file, but ask a tax adviser to explain the actual fiscal position instead of treating a general registration checklist as proof of every later VAT outcome.

Technical changes must be declared to the maritime service under the Ministry's guidance; replacement-engine evidence includes the invoice or sale document with technical characteristics. As practical advice, gather the engine, servicing and alteration records before marketing the yacht and compare them with the current title. Make the papers available alongside any existing survey history, explaining the date and scope of an older report. A document that described the yacht before a later alteration should not be supplied without explaining the change or assumed to represent the boat's present condition.

Broker tip: Practical recommendation: gather ownership, registration, fiscal and technical records before advertising. Establish all owners' involvement and ask the adviser to resolve mortgage or tax questions, while labelling older surveys by their actual date and scope. Section 2

Market the actual yacht and organise a safe viewing

As practical advice, describe the actual yacht accurately and prepare photographs that help a prospective buyer understand its layout and condition. Compare the listing with the permanent watercraft identification and the fixed builder's plate described in the Ministry's construction guidance for covered CE boats. Keep the asking price distinct from a promised valuation result, and explain known issues or unfinished work rather than substituting another model's specification. Running the sale yourself makes an organised evidence file particularly useful when responding directly to a buyer's questions.

The Ministry's construction guidance identifies the written conformity declaration as the manufacturer's or representative's conformity commitment and describes the owner's manual as containing safe-use, installation, maintenance and risk information. As practical advice, let a serious buyer or surveyor review those documents alongside the boat's history. They support understanding of the yacht but do not supply a new assessment of present condition. Record the date and scope of any existing survey, explain later alterations and agree access for a buyer's own inspection where the parties choose it.

Service Public distinguishes the general optional position for pleasure insurance from the compulsory exception for vessels with gross tonnage of at least 300. It also explains that ports or marinas may require an insurance certificate for a berth. As practical advice, check the actual policy and operator's conditions before organising a viewing or trial, and ask the insurer about the proposed activity and operator. Do not assume a quiet berth viewing and an underway trial have identical cover or that a marina place passes automatically with ownership.

Broker tip: Practical recommendation: market the actual yacht with supporting records, state the scope of older reports and check the proposed viewing or trial with the insurer and operator before confirming arrangements. Section 3

Deal with condition questions and obtain legal review

Article 1641 of the Civil Code addresses hidden defects that make the thing unsuitable for its intended use or reduce that use so substantially that the buyer would not have bought it, or would have paid less, had they known. As practical advice, record the yacht's known condition and relevant history accurately, and let the buyer's surveyor assess the present boat. The provision should not be described as an automatic guarantee that every later mechanical problem qualifies, because the legal criteria and evidence need assessment in the actual case.

Article 1642 distinguishes apparent defects that the buyer could establish themselves. As practical advice, keep the viewing, inspection and disclosure record clear, including the report's date, scope and any agreed exclusions. A survey is useful evidence but this guide does not claim it automatically eliminates every legal question about a later defect. Give the adviser the actual records if a problem emerges, so they can distinguish what was visible, what was disclosed and what the buyer could reasonably assess within the agreed inspection arrangements.

Article 1644 describes the buyer's choice, in the applicable hidden-defect cases, between returning the thing for reimbursement and keeping it with a partial price refund. Article 1648 requires the relevant action brought within two years from discovery of the defect. As practical advice, obtain legal advice promptly where a serious issue appears, and preserve evidence rather than assuming a standard repair allowance or a two-year warranty beginning at handover. The appropriate remedy, proof and limitation analysis depend on the facts and the applicable legal framework. No compulsory broker appointment, standard private-sale discount, guaranteed sale timetable or statutory photography package was verified. Practical marketing and inspection recommendations do not replace case-specific technical, legal or fiscal assessment. For these, email us at info@europeanyachtbrokers.com for the latest information.

Broker tip: Practical recommendation: document condition and inspection scope accurately, preserve reports and disclosures, and seek prompt legal advice on serious defects. Do not assume a survey or generic exclusion removes every possible remedy. A related question is answered in our guide on what goes in a boat sale contract in France.

Section 4

Use the written sale instrument and finish the private declaration

The Transport Code requires a written instrument for transferring ownership or another real right in a registered vessel, failing which the instrument is void. It must identify the interested parties and the vessel. As practical advice, have a qualified adviser review the actual sale document even where you negotiate and organise viewings yourself. A private sale does not turn the registered-vessel writing requirement into an optional formality, and a downloaded template should be checked against the yacht, owners, payment arrangement and any conditions the parties intend.

For an eligible private online transaction, the Ministry describes the seller starting the operation and uploading the sale document, then the buyer completing their part using the transfer code. All co-owners must confirm the operation. As practical advice, agree that sequence before handover and ensure the people needed are available to finish it. Keep signing, payment, delivery and the administrative outcome visible as separate completion tasks, so neither side assumes that the other will deal with a missing confirmation after the yacht has changed hands.

The Transport Code requires the sale instrument presented to the competent administration within one month from sale. The Ministry warns that an unrecorded transfer leaves the seller as administrative owner and annual-tax debtor until recorded. As practical advice, verify the actual recorded result and retain the confirmation with the signed instrument and handover evidence. Use the competent service promptly where the personal online route is unavailable or incomplete, rather than assuming a private agreement between the parties changes the official record without the required declaration.

Broker tip: Practical recommendation: obtain review of the actual private sale instrument, plan every co-owner's participation and verify the recorded declaration result. Keep that confirmation with the payment and physical handover evidence. See also our guide on how yacht sale escrow works in France.

Your questions

Frequently asked questions

Does selling privately remove the written maritime sale requirement?

No. The Transport Code requires a written instrument identifying the parties and registered vessel when ownership or another real right is transferred, failing which it is void. As practical advice, obtain review of the actual document and applicable law even if you conduct marketing and negotiation yourself. A private arrangement does not make this specific maritime requirement optional. (Legifrance, Transport Code vessel property provisions)

What should I prepare before a serious buyer reviews the yacht?

The Ministry's transfer checklist includes the signed sale evidence, vessel and party identification, existing registration and relevant owner documents. As practical advice, prepare the ownership and technical history, establish every owner's involvement and have the adviser resolve authority or mortgage questions. Keep older surveys clearly dated and scoped instead of treating a historical report as a current assessment of the yacht. (French Maritime Ministry, buying and registering sea-going boats)

Is insurance irrelevant while a privately marketed boat stays in a marina?

Service Public explains that ports or marinas may require a berth insurance certificate, alongside the general optional position and the compulsory exception for vessels of gross tonnage at least 300. As practical advice, check the actual policy and operator's conditions before a viewing or trial. The particular activity, operator and location should be confirmed rather than assuming existing arrangements cover everything. (Service Public, pleasure boat insurance)

Does an inspection automatically remove hidden-defect questions?

This guide makes no such claim. The Civil Code distinguishes qualifying hidden defects from apparent defects the buyer could establish, and provides remedies and a discovery-based action deadline in applicable cases. As practical advice, preserve inspection and disclosure records and obtain legal advice on a serious issue. A survey's existence alone does not answer every factual or legal question about a later problem. (Legifrance, Civil Code hidden-defect provisions)

What should I check after the buyer completes the online steps?

As practical advice, verify the actual recorded ownership result and retain the confirmation with the signed sale and handover evidence. The Ministry warns that an unrecorded transfer leaves the seller as administrative owner and annual-tax debtor until recorded. Agree the seller, buyer and co-owner sequence in advance, and contact the competent service promptly if the declaration does not complete as expected. (French Maritime Ministry, buying and registering sea-going boats)
