Can a Non-Resident Sell a Boat in France? 2027

Plan remote signing, representative powers, buyer registration and the recorded ownership change using the actual transaction facts.

By Peter Mattey · 9 min read · Facts checked 2026-10-03

Selling a boat non-resident France requires clear information about the actual owner, yacht and buyer, rather than assumptions based on the seller being abroad. The proposed registration, any representative's authority and the written sale instrument need to fit the transaction. Completion also includes the administrative declaration and its recorded result. This guide uses current official sources to explain those checks and practical organisation, without inventing a non-resident exemption, a universal consular signing procedure or a compulsory change of flag.

Remote-completion recommendations are practical advice, while the cited legal provisions are the consolidated versions in force on 3 October 2026. Confirm current requirements with the relevant authority or a qualified adviser. Seller residence alone does not establish the buyer's registration eligibility or resolve the transaction's VAT, export, mortgage and tax position. Section 1

Distinguish the seller's residence from the buyer's registration

A seller being abroad does not answer every registration question about the buyer or yacht. The Ministry's guidance sets specific ownership and domicile conditions for French registration, including qualifying ownership of at least half the vessel and the relevant French principal-residence or elected-domicile arrangement for eligible individuals. As practical advice, have the maritime service or qualified adviser check the buyer's actual eligibility before assuming that a boat already in a French marina will simply remain on the same register after any cross-border transaction.

The Ministry's document guidance calls for identity and domicile evidence and, for European nationals resident in France for less than six months, an attestation of election of domicile in France. As practical advice, clarify the buyer's actual documentation with the service rather than treating the seller's foreign address as a substitute for the buyer's eligibility file. Keep the ownership change and any proposed flag change distinct. A yacht's berth location, owner nationality and residence are separate facts that need to be described accurately in the transaction.

The Ministry excludes companies and associations from the personal online registration route, and identifies the existing certificate among ownership-change documents. As practical advice, establish the actual seller and buyer entities, the yacht's current registration and the correct service channel before committing to completion arrangements. An owner signing from another country may need particular assistance, but this guide does not invent a universal consular or notarisation requirement. Ask the adviser and authority what evidence they need for the transaction, then organise the signing and declaration accordingly.

Broker tip: Practical recommendation: separate seller residence, buyer eligibility, entity type and the yacht's register. Obtain the service's actual document requirements before planning remote signing or assuming the existing flag will continue. Section 2

Define any representative's powers before remote completion

Where someone acts for an owner abroad, the Civil Code defines a mandate as giving another person power to act for the principal and in their name, with the contract formed by the agent's acceptance. As practical advice, use clear written instructions reviewed for the actual transaction, naming the principal and representative and identifying the boat and intended tasks. Arranging photography or attending a viewing should not be treated as proof of authority to accept an offer, sign the maritime instrument or receive the sale money.

Article 1988 distinguishes a generally worded mandate covering administration from the express mandate required for alienation or another ownership act. Article 1989 prevents the agent exceeding the granted powers. As practical advice, have the adviser check the authority to sell and sign, then explain which decisions remain with the owner abroad. Keep any limits, approval process and changes to instructions clear in the transaction file. Remote communication should support an identified authority arrangement rather than leave the buyer to guess who can bind the seller.

Article 1993 requires an agent to account for their management and everything received under the mandate. As practical advice, specify how documents, offers and any authorised money receipt will be recorded and reported to the owner, and independently verify the actual payment arrangements before funds move. This general accounting duty does not prove that a broker supplies regulated escrow or an insolvency-protected account. Ask the adviser to review the proposed money-handling terms and evidence, especially where several parties or countries are involved in the completion sequence.

Broker tip: Practical recommendation: identify the representative's precise signing, negotiation and receipt powers and retain the agreed instructions. Verify the actual payment arrangement rather than treating a general agency duty as an escrow guarantee. A related question is answered in our guide on how to transfer boat ownership in France.

Section 3

Check the written sale and any proposed change of flag

The Transport Code requires an instrument transferring ownership or another real right in a registered vessel to be recorded in writing, failing which it is void. It must identify the interested parties and vessel. As practical advice, have the actual cross-border sale instrument reviewed for applicable law, ownership and signing authority, even where the seller will not attend the marina. A remote negotiation does not dispense with the maritime writing requirement, and the form of signing and evidence accepted should be established with the adviser and service.

Article L5114-3 describes a vessel record containing identification, owner and co-owner names with their shares or quotas, and rights over the boat. As practical advice, compare those records with the proposed buyer and any flag-change plan before completion. The owner abroad should supply the actual acquisition and registration file, while the adviser investigates relevant rights and security interests. Do not assume that a change of owner necessarily requires the same register outcome in every case or that the seller's residence settles the applicable administrative route.

The current Transport Code, incorporating mortgage provisions effective from May 2026, prohibits a voluntary operation causing loss of French status for a mortgaged vessel, subject to the specified suspension exception. As practical advice, have the adviser review any proposed deregistration or flag change against the actual mortgage position before promising it to the buyer. Keep discharge evidence and authority communications in the sale file. This is a specific security-related restriction, not a claim that every non-resident sale is prohibited or that every yacht must change flag. No universal non-resident exemption, consular/notarial signing requirement or mandatory flag-change rule was verified. Specific seller tax residence, capital-gains, VAT/export and buyer-registration outcomes require qualified case-specific assessment and are not invented here. For these, email us at info@europeanyachtbrokers.com for the latest information.

Broker tip: Practical recommendation: review the actual registered-vessel instrument and any flag-change plan together. Resolve authority, ownership and mortgage questions before promising deregistration or accepting a completion sequence involving another register. Section 4

Follow through the declaration and the actual tax position

The Transport Code requires the sale instrument presented to the competent administration within one month from sale. As practical advice, agree who completes the declaration and how the owner abroad receives the result, then keep the required people available to respond to a missing document. The Ministry warns that an unrecorded transfer leaves the seller as administrative owner and annual-tax debtor until recorded. Physical handover to a buyer or a representative should therefore be followed by verification of the official outcome, not treated as confirmation in itself.

The Ministry's annual-tax guidance identifies the person recorded on 1 January as liable for the year. As practical advice, ask the adviser to distinguish that annual assessment from the administrative warning about an unrecorded sale, and check the actual account before discussing any private adjustment between buyer and seller. This guide does not establish an automatic exemption, refund or fixed apportionment because an owner lives abroad. Residence, registration and the yacht's history need a case-specific assessment, with the relevant authority confirming the applicable procedure.

The annual-tax guidance separately addresses foreign-flag vessels owned or used by French residents and the relevant administrative passport requirement. As practical advice, describe the parties' actual residence and proposed future use accurately if the sale includes a flag or residence change. Do not infer exemption from flag alone, and obtain separate advice about any import, export or VAT consequences of the buyer's plan. Retain that advice alongside the signed sale and registration result rather than making an unsupported tax assurance in the listing or completion correspondence.

Broker tip: Practical recommendation: verify the recorded ownership outcome from abroad and retain the result. Obtain case-specific tax and flag advice, distinguishing official annual liability from any private adjustment or proposed cross-border movement. Your questions

Frequently asked questions

Does the seller living abroad decide the buyer's registration eligibility?

No. The Ministry sets specific qualifying ownership, nationality or company, and domicile conditions for French registration. As practical advice, have the service or adviser check the buyer's actual eligibility and documents before assuming the existing register will continue. Keep seller residence, buyer residence, entity type and the yacht's current flag distinct when describing the proposed transaction. (French Maritime Ministry, buying and registering sea-going boats)

Can a representative abroad or at the marina sign without checking powers?

The Civil Code distinguishes general administrative authority from the express mandate required for alienation or another ownership act, and prevents an agent exceeding the granted powers. As practical advice, have the adviser review the actual instructions and signing authority before completion. Permission to market or show the yacht should not be assumed to include acceptance, signature or money receipt without verifying the mandate. (Legifrance, Civil Code mandate provisions)

Is changing flag always straightforward where a mortgage exists?

The current Transport Code prohibits a voluntary operation causing loss of French status for a mortgaged vessel, subject to its specified suspension exception. As practical advice, ask the adviser to check the actual mortgage position and proposed register change before promising deregistration. This specific restriction is not a claim that every non-resident sale is prohibited or that every transaction requires a flag change. (Legifrance, Transport Code vessel property provisions)

Does non-resident status create an automatic annual-tax refund?

No automatic non-resident refund or apportionment formula is established by these sources. The Ministry identifies the person recorded on 1 January as liable for the annual tax year. As practical advice, check the actual account and obtain case-specific advice, distinguishing the official assessment from any private price adjustment. Do not present residence alone as proof of the yacht's entire fiscal position. (French Maritime Ministry, annual personal vessel tax)

What should the owner abroad receive after the sale?

As practical advice, retain the signed sale instrument and the actual administrative ownership-change result alongside payment and handover evidence. The maritime instrument must be presented within one month from sale. Agree who completes the declaration and how confirmation reaches the owner abroad, and follow up with the competent service if the expected recorded result is missing or incomplete. (Legifrance, Transport Code vessel property provisions)
