THE EYB COUNTRY GUIDES · France
Prepare the signed instrument, follow the correct service sequence and verify the recorded change after handover.
By Peter Mattey · 9 min read · Facts checked 2026-10-03
Boat ownership transfer France involves the signed transaction and the administrative record of the yacht. For an eligible private sale, the Ministry describes an online sequence involving the seller, buyer and any co-owners; other ownership structures need the appropriate service route. The Transport Code also sets requirements for the written instrument and its presentation. This guide explains the verified steps and practical preparation needed to keep the yacht's identity, ownership evidence and recorded outcome consistent throughout completion.
The rules cited are current official guidance and consolidated provisions checked on 3 October 2026. Practical organisation advice is labelled accordingly. Confirm current requirements with the relevant authority or a qualified adviser, especially for companies, several owners, security interests, a different flag or changes to the parties' residence. The Transport Code requires the written ownership instrument for a registered vessel to identify the interested parties and the vessel. As practical advice, compare the proposed transaction with the registration certificate and the actual identifying records before collecting signatures. Resolve discrepancies in names, ownership shares or the yacht's particulars through the competent service and adviser. The declaration should describe the transaction that is taking place, rather than relying on a familiar boat name or assuming the person attending handover owns every interest in the vessel.
Article L5114-3 describes a vessel record containing identification, the owner's name and, where there are several co-owners, all their names and their shares or quotas. It also includes rights over the vessel. As practical advice, ask the adviser to review the ownership and rights position against the proposed sale, especially where a company, several owners or a representative is involved. A registration document should not be treated as an unrestricted promise that no further authority or title investigation is needed before completion.
Article L5114-4 makes the inscription file public and permits extracts through the specified administrative-access arrangements. The Ministry separately recommends checking the mortgage position with the competent commercial court before purchase. As practical advice, obtain the relevant evidence through the adviser and authority rather than asking the seller to make unsupported assurances about every possible right. Keep those enquiries with the sale file, distinguishing ownership identification from the separate investigation of security interests and the arrangements needed to discharge any relevant obligation.
Broker tip: Practical recommendation: compare the signed parties and yacht identity with the actual records, establish every ownership interest and obtain the relevant rights enquiries before agreeing the completion sequence. Section 2
The Maritime Ministry's ownership-change checklist calls for the invoice or sale document signed by all parties, with vessel and party identification. It also identifies the existing registration certificate and relevant identity and domicile documents. As practical advice, prepare a complete readable file before handover, confirm that every necessary owner is available to sign and keep copies of the completed instrument. Missing papers are easier to resolve while the parties are still engaged than after the buyer has moved the yacht or the seller has left.
Eligible personal online registration procedures are free according to the Ministry, while companies and associations cannot use that personal online route. As practical advice, establish the owner type and service channel before allocating the declaration tasks. A free official personal procedure does not mean that every separately commissioned adviser service is free, and a company sale should not be forced into an individual's account. Ask the competent maritime service about the appropriate route where the ownership structure or proposed transaction falls outside the eligible personal process.
As practical advice, treat the service's document list as a checklist for the actual ownership change, and ask about additional evidence where the yacht or parties have a cross-border history. The Ministry's requirements distinguish the existing registration record from the signed sale evidence and the owner's identity and domicile particulars. Keep the contract, payment and handover records organised separately but consistently. Administrative document preparation should support the real transaction, rather than substitute for legal review of the seller's authority or the buyer's fiscal and registration eligibility.
Broker tip: Practical recommendation: prepare the signed document and supporting records together, establish the correct individual or corporate service route and clarify any case-specific additional evidence before the parties complete the sale. Section 3
For an eligible private transaction using the online service, the Ministry describes a sequence started by the seller, who uploads the sale document. The buyer then uses the transfer code to finish their part. As practical advice, agree when each person will act and keep the parties available to resolve a missing item or an unexpected service message. The buyer receiving the keys is not the same event as the portal recording the ownership change, so follow the declaration through to its actual outcome.
The Ministry states that all co-owners must confirm the online operation. As practical advice, check access and availability for everyone involved before the planned completion date, rather than assuming one owner's action will automatically cover the others. The Transport Code separately requires the sale instrument presented to the competent administration within one month from sale. Keep the statutory time limit visible in the transaction plan and use the appropriate service channel promptly where the online route is unavailable or the parties cannot finish it as expected.
The Ministry explains that changes to ownership, domicile, motorisation or exit from the fleet must be requested within one month. As practical advice, check whether the transaction also involves a relevant technical or contact change, and ask the service how to supply the corresponding evidence. Do not assume that an ownership operation corrects every other detail automatically. Retain the final certificate or administrative confirmation with the signed sale, so the buyer and seller can compare the recorded outcome with the vessel and parties actually involved. No universal mid-year annual-tax refund or private apportionment formula was verified. The eligible private online sequence is not extended to companies or associations; unusual authority, flag, tax and residence cases need service and adviser review. Broker tip: Practical recommendation: agree the seller and buyer declaration sequence, ensure every co-owner can participate and follow the actual result. Address related technical or contact changes through the appropriate service within the relevant period. Readers often go on to our guide on whether you pay VAT on a boat in France.

The Ministry warns that an unrecorded transfer leaves the seller as administrative owner and annual-tax debtor until the change is recorded. It also explains that the seller may notify the service of the sale. As practical advice, check the administrative outcome after the buyer completes their part and keep the confirmation in the transaction file. If the transfer has not been recorded, contact the competent service with the signed evidence rather than assuming physical handover or a private message has updated the official record.
The annual-tax guidance updated in September 2026 separately identifies the person recorded on 1 January as liable for that year. As practical advice, ask an adviser to distinguish this annual assessment from the warning about an unrecorded ownership change and from any private adjustment in the agreed price. Recording the new owner is essential administrative work, but it does not by itself establish a universal mid-year tax split or refund formula. Use the actual tax account and the applicable year's rules when checking the consequences.
The annual-tax guidance also addresses foreign-flag vessels used or owned by French residents and describes the relevant administrative passport requirement. As practical advice, obtain a case-specific answer if a change of owner also involves a flag change, residence change or foreign buyer. Do not infer from a new flag alone that the yacht leaves every French obligation behind. Ask the maritime service and tax adviser which declaration, registration or tax steps apply, and keep that advice with the signed sale and the final recorded outcome.
Broker tip: Practical recommendation: verify the official ownership result and retain confirmation. Review annual-tax assessment separately, and seek case-specific service and adviser guidance where flag, residence or cross-border arrangements also change. Your questions
The Transport Code vessel record includes every co-owner's name and their shares or quotas, while the written ownership instrument must identify the interested parties and vessel. As practical advice, compare those records with the proposed sale and have an adviser resolve authority questions before signing. Do not assume the person arranging the viewing represents every interest without checking the actual ownership evidence. (Legifrance, Transport Code vessel property provisions)
The Ministry states that companies and associations cannot use the personal online registration route. As practical advice, contact the competent maritime service about the appropriate channel before completion and prepare the actual ownership and authority documents. The eligible personal online procedure being free does not justify placing a corporate transaction in an individual's account or assuming its document needs are identical. (French Maritime Ministry, buying and registering sea-going boats)
The Ministry describes the seller starting the operation and uploading the sale document, with the buyer completing their part using the transfer code and all co-owners confirming. As practical advice, agree the timing, ensure every necessary person can participate and retain the final administrative result. Key delivery and the portal's recorded ownership outcome should both be checked in the completion plan. (French Maritime Ministry, buying and registering sea-going boats)
Transport Code Article L5114-1-1 requires the sale instrument presented to the competent administration within one month from sale. As practical advice, organise that presentation with signing and handover, retain complete copies and use the appropriate service route promptly if the online sequence is unavailable. A signed document remaining only in the parties' private file does not demonstrate that presentation has occurred. (Legifrance, Transport Code vessel property provisions)
No universal mid-year refund or apportionment formula is established here. The Ministry identifies the person recorded on 1 January as liable for the annual tax year. As practical advice, check the actual account and ask the adviser to distinguish official liability from any private price adjustment. Recording the ownership change remains a separate administrative task that should be verified after handover. (French Maritime Ministry, annual personal vessel tax)
