THE EYB COUNTRY GUIDES · Portugal
Check which craft require liability insurance, the verified minimum capital and the limits you should discuss before handover.
By Peter Mattey · 9 min read · Facts checked 2026-10-03
Boat insurance Portugal begins with the compulsory third-party liability requirement for the actual craft, then moves to the cover you want for your own purchase and use. The recreational regime identifies the craft subject to insurance, and the retained insurance order sets contract conditions and exclusions. This guide explains those verified rules in plain English, with practical recommendations for comparing a quotation and arranging cover before handover. It does not invent a standard annual premium or promise that compulsory cover includes everything.
Buyers should check the proposed policy before taking possession, while sellers should coordinate the handover and their existing cover with the insurer. Confirm the boat's authorised area, intended use and the policy dates. Ask the insurer or qualified adviser about an unclear condition rather than treating a headline certificate as the complete contract. For anything this guide does not cover, email us at info@europeanyachtbrokers.com for the latest information.

ASF's official record reproduces Article 33's liability-insurance requirement for types 1–4, powered type 5 craft and sailing type 5 craft longer than seven metres. (Current ASF official record of Decree-Law 93/2018, published 13 November 2018; no page revision date displayed.)

Diário da República – Official legislation or service information r ·Section 1
The compulsory requirement reproduced by the insurance supervisor (ASF) covers recreational types 1–4, powered type 5 craft and sailing type 5 craft longer than seven metres. Use the boat's actual classification and particulars to identify the relevant position. As a practical recommendation, provide these records when requesting a quotation rather than assuming a small boat or a foreign purchase is automatically outside the rules. Ask the competent authority or qualified adviser about a craft whose classification or permitted use is uncertain.
Article 32 makes owners and commanders jointly liable for third-party damage caused by the craft, independently of fault and subject to the stated exclusive-victim-fault exception. This is a statutory responsibility rule, not a guarantee about the result of an individual claim. As a practical recommendation, explain to the insurer who owns the boat and who will command it, then ask how the proposed policy documents the relevant parties and use. Keep responsibility, policy scope and additional optional protection as separate questions.
The retained insurance order makes compliance with the obligation a prerequisite for navigation, and the recreational code includes the applicable liability policy among onboard documents. As a practical recommendation, agree the start of the new owner's cover before departure and obtain the evidence required for the boat's file. A seller and buyer should each ask their insurer how the handover affects their respective arrangements. Do not assume the seller's policy continues for the buyer merely because a copy remains aboard.
Broker tip: Use the documented classification and intended use when asking for cover. Confirm the insured parties, start of cover and required evidence before handover, with the owner's and commander's positions considered separately. Craft requiring cover
Section 2
Point 3 of the insurance order gives compulsory cover a national territorial scope including the Portuguese exclusive economic zone, territorial sea and inland waters. Point 4 requires the contract to take account of the boat's authorised navigation areas recorded in its registration. As a practical recommendation, compare your intended passages with both the boat record and policy terms. Ask the insurer to explain any geographical condition in writing rather than assuming an offshore description gives unlimited insurance cover for every voyage.
Foreign craft entering or leaving Portuguese ports through national territorial or inland waters fall within the order's stated provision, with exceptions for forced entry or suitable existing insurance in the country of registration covering the same eventualities. This is a conditional rule, not a general exemption for every foreign flag. As a practical recommendation, send the existing policy wording to the insurer or qualified adviser and ask whether it meets the applicable position for the planned visit and use.
The order describes liability arising from use of the craft and from towing skiers or other objects. As a practical recommendation, state the activities you actually intend, including any towing, when requesting cover and ask what the contract includes or excludes. Do not add commercial use to a private-boating description without checking the separate applicable framework. Keep the response with the policy documents so an agreed activity is traceable, and ask about any later change before relying on the earlier quotation.
Broker tip: Describe the intended waters and activities accurately and compare them with the registration and policy wording. For foreign cover, obtain a written assessment of the applicable equivalent-cover condition before relying on it. See also our guide on what safety equipment a boat must carry in Portugal.

Section 3
Point 7 of the order sets minimum compulsory liability capital at €249,398.94 per accident or series of accidents arising from the same event, regardless of the number of victims or the nature of the damage. That is a statutory capital figure, not an annual premium or a recommendation that the minimum is sufficient for your plans. As a practical recommendation, ask the insurer to explain the limit offered and how higher cover would change the quotation, without inventing a standard premium comparison.
Damage to the recreational craft itself is excluded from the compulsory guarantee under point 9(a). Consequently, a liability document should not be treated as evidence that the boat's own damage is insured. As a practical recommendation, ask separately about the risks you want covered for the hull, equipment and other interests, with limits and exclusions explained. Record which cover is compulsory and which is additional contractual protection so a simple certificate does not conceal a gap in your purchase expectations.
Point 13 allows an expressly agreed insured share of third-party compensation but prevents that limitation being asserted against the injured parties or their heirs. Point 12 addresses proportionate reduction where multiple claims together exceed the insured capital. As a practical recommendation, ask the insurer to explain these contract and limit questions in accessible terms before acceptance. The sources here establish no typical annual cost, customary excess or all-risks package, so compare actual written quotations rather than a guessed ownership percentage. No typical premium, customary excess or standard optional-cover package was verified. A specific insurer's underwriting, sale-continuation arrangement and claims result were not determined. Broker tip: Compare the offered limit, insured share and exclusions before looking at premium alone. Ask separately about damage to your own boat, and keep optional cover and the statutory liability guarantee clearly identified. Readers often go on to our guide on how much a berth costs in Portugal.

Point 16 ties the contract to liability from accidents during the policy period and to claims made within the periods in the policy. As a practical recommendation, read the start and end dates together with the claim wording before agreeing a handover or departure. Ask the insurer how a reported incident should be notified and which records should be preserved. This guide does not invent a universal notification deadline, and a purchase date by itself should not be treated as confirmation that cover has started.
Insurance evidence must be shown to competent authorities on request under point 22, and point 23 assigns verification to the Maritime Authority System. As a practical recommendation, organise the evidence with the applicable onboard documents and confirm that the boat and insured details are correct. Keep contact information accessible and ask how electronic or paper evidence will be supplied. Resolve a missing or inaccurate certificate with the insurer before treating the insurance file as complete for the proposed navigation.
Point 15 gives specified grounds for insurer recovery after compensation, including intentional accidents and certain unlawful or unqualified command situations. Payment to a third party therefore should not be confused with an unconditional promise that every insured person bears no later consequence. As a practical recommendation, obtain clarification of an unclear recovery condition from the insurer or qualified adviser. If an incident occurs, preserve the facts and seek appropriate help; the contract and circumstances need review rather than a general prediction about the eventual claim.
Broker tip: Check dates, claim wording and evidence before departure. Keep the policy and insurer contact details accessible, and ask about any unclear exclusion or recovery condition before accepting the proposed arrangement. Your questions
No: the requirement includes powered type 5 craft as well as types 1–4 and sailing type 5 craft longer than seven metres. Determine the actual classification and particulars before relying on an exemption. As a practical recommendation, supply the records to the insurer and ask about any uncertain case, rather than treating a boat's size or a seller's description as the complete answer. (ASF)
Point 7 of Portaria 689/2001 sets €249,398.94 per accident or series arising from the same event, regardless of victim count or damage nature. This is an insured-capital requirement, not a premium quotation or an all-inclusive protection recommendation. Ask the insurer to explain the offered limit and compare any additional protection with the actual use you intend. (Diário da República)
No: point 9(a) excludes damage to the recreational craft itself from the compulsory guarantee. Ask the insurer separately about any own-boat protection you want, including the offered limits, exclusions and contractual terms. Keep that optional protection distinct from the statutory third-party guarantee, and review the complete wording rather than assuming a liability certificate establishes cover for the boat's hull or equipment. (Diário da República)
The order contains a conditional exception for existing insurance in the craft's registration country that can respond to the same covered eventualities, alongside its forced-entry exception. Do not assume every foreign policy qualifies. As a practical recommendation, provide the actual wording and intended visit to the insurer or qualified adviser and obtain a clear assessment before relying on the existing cover in Portuguese waters. (Diário da República)
No continuation should be assumed without checking the actual arrangement with the insurer. The statutory order ties cover to accidents during the policy period and claims within the policy's stated periods, while insurance compliance is required for navigation. As a practical recommendation, confirm the buyer's insured details, start of cover and evidence before handover or departure, and have each party clarify their own policy position. (Diário da República)
