THE EYB COUNTRY GUIDES · Spain
Follow the purchase from identifying the boat and seller to agreeing the inventory, checking costs and planning a lawful handover.
By Peter Mattey · 9 min read · Facts checked 2026-10-03
Buying a boat Spain questions begin with the boat you are actually purchasing and the person entitled to sell it. Photographs and an asking price cannot answer the document, condition and handover questions. Start with a consistent set of identification and ownership information, then ask a locally qualified adviser to assess the proposed sale. A written purchase plan helps you identify what is already established and what still needs checking before you commit money.
This guide covers the purchase sequence for a recreational boat, using official Spanish registration, inspection and maritime-sale rules. It distinguishes legal requirements from practical recommendations. The precise tax treatment, flag choice and technical scope depend on the transaction. Those subjects need their own assessment rather than an assumption based on the advertised boat. Key facts at a glance
Royal Decree 1435/2010, Articles 2 and 5, identifies the official boat record (hoja de asiento) as the physical or electronic record in which registrable acts and the boat's history are entered, in the consolidated text checked 3 October 2026.
BOE – recreational boat registration ·Law 24 July 2014,14/2014, de Navegación Marítima, Article 117 requires a detailed inventory identifying the elements sold with the vessel; Article 121 extends the sale provisions to craft where their nature permits, in the consolidated text checked 3 October 2026.
BOE – Maritime Navigation Act ·Law 14/2014, Article 118(1), requires the vessel sale contract to be in writing; Article 121 extends the provisions to craft where their nature permits, with Article 118's version effective 27 May 2015 current in the text checked 3 October 2026.
BOE – Maritime Navigation Act ·AEAT's current maritime guidance checked 3 October 2026 states that first matriculation of new or used recreational vessels longer than 8 metres is subject to matriculation tax, with a separate first-matriculation rule for jet skis regardless of length.
AEAT – maritime matriculation-tax scope ·Royal Decree 10 September 1999,1434/1999, por el que se establecen los reconocimientos e inspecciones de las embarcaciones de recreo, Article 4 requires the seaworthiness certificate to record statutory inspections and their next dates, in the consolidated text checked 3 October 2026.

As a practical first step, ask for the boat's identification documents and compare them with the yacht presented for sale. Check whether the owner's name, identifying number and technical description are consistent. Spain's registration decree distinguishes the boat's record from its registration and navigation document. Ask a locally qualified adviser to explain the evidence of ownership and any charges in your particular case. Do not treat a navigation document alone as a complete answer to every title question before making an offer.
The recreational registration framework has a defined size scope and exclusions. It also includes a special route for qualifying CE-marked boats with CE-marked propulsion. CE marking is the product-conformity marking used in that rule, not an assertion of the boat's present maintenance condition. Ask the maritime authority to identify the route relevant to the yacht. If you plan to sail outside Spanish territorial waters, discuss that intention before assuming every form of Spanish inscription supports the voyage you have in mind.
Keep your intended use in view. A private purchase for leisure and a boat intended for commercial operation need an assessment of the actual registration and operating arrangements. This guide does not establish that changing the advertisement or sale contract changes the boat's regulatory position. As a recommendation, give the adviser a written description of the use you intend, the delivery route and any changes planned after purchase. Resolve document inconsistencies before trying to settle price and completion terms.
Broker tip: As a practical preparation step, send the adviser the identification documents and your intended use together. Ask for any mismatch in the boat description or ownership information to be explained before discussing an unconditional purchase. A related question is answered in our guide on whether you need a boat survey in Spain.

Defined recreational scope
Section 2
After identifying the boat and seller, set out the proposed purchase terms in writing. The Maritime Navigation Act contains specific sale provisions that extend to recreational craft where their nature permits. Ask a locally qualified lawyer to confirm their application to your transaction, including any consumer-law or cross-border issues. As a practical recommendation, state the intended inspection and trial arrangements clearly before money is committed. This guide does not invent a compulsory survey condition or deposit percentage for every Spanish yacht purchase.
The sale provisions address a detailed inventory identifying the elements included with the boat. Treat that as an opportunity to remove uncertainty about equipment and loose items before completion. As a recommendation, compare the written inventory with what you inspect and ask for exclusions to be explicit. Do not assume that an item visible in a photograph is included solely because it appeared there. Ask the adviser to explain the statutory default and the effect of the wording adopted in the actual contract.
Plan delivery and the relevant registration steps alongside the signing arrangements. The Maritime Navigation Act distinguishes acquisition of ownership by delivery from the formalities required for effect against third parties. Administrative maritime records are a separate part of the picture. Ask the adviser to allocate the work and identify the documents needed before release of the balance. These are recommended completion checks. They do not create a universal sequence that fits every flag, financing arrangement or form of recreational craft.
Broker tip: As a practical contract check, agree the inventory and handover evidence before completion. Ask a locally qualified lawyer to explain signing, delivery and third-party registration separately so each step has an identified person responsible. Section 3
Build the budget from the actual transaction rather than an assumed national total. As a recommendation, separate the boat price from inspection, lifting, delivery, berthing and professional charges, and obtain written quotations for the work you plan. The tax treatment needs a separate assessment based on the seller, movement and relevant jurisdiction. No universal purchase-cost percentage is established here. This guide does not substitute a broker's estimate for an official tax rule or a provider's written quotation for your boat.
Matriculation tax has its own scope. Official tax-authority guidance addresses the first matriculation of new or used recreational vessels over the stated length threshold and a separate rule for jet skis. That does not answer every purchase-tax question or establish that every existing boat sale triggers first-matriculation tax again. Give a qualified tax adviser the actual registration history and intended use before relying on an explanation of tax already paid. Keep the advice with the sale documents and the supporting evidence.
Allow the budget and timetable to remain provisional while checks are outstanding. Ask each provider to identify the service, payer and delivery arrangements in its quotation. Where several charges are quoted, add those actual amounts to the agreed price and verified taxes so the total can be reviewed. This is a recommendation for purchase planning. No universal official brokerage tariff, survey price, marina charge or processing time has been verified in this pack, so no numerical total is fabricated. No universal survey charge, brokerage fee, marina charge, purchase-cost percentage or completion processing time was verified. VAT, regional transfer tax, matriculation-tax rates and transaction-specific exemptions require their separate guides and qualified assessment. For these, email us at info@europeanyachtbrokers.com for the latest information.
Broker tip: Ask for a written cost schedule using actual quotations and a transaction-specific tax assessment. Keep uncertain amounts identified as outstanding, and confirm the payer before authorising inspections, lifting or delivery work. Readers often go on to our guide on how to register a boat in Spain.

Review the inspection record before relying on the yacht being ready to sail. The inspection decree describes the seaworthiness certificate, called certificado de navegabilidad, and records the required surveys and future dates. Ask the competent authority or authorised inspection body to assess the applicable position for the boat. A purchase inspection you commission for your own decision is a separate instruction from a regulatory certificate. This guide does not claim that a satisfactory private survey automatically renews the official document.
Use the actual certificate and boat history when planning departure. The statutory inspection framework includes periodic, intermediate and event-related checks, and the certificate can expire when required checks are not completed successfully in time. As a practical recommendation, ask the seller to supply the relevant records and explain repairs or alterations before fixing a delivery date. Do not assume that a calendar entry for the next periodic inspection settles the effect of every subsequent accident or significant change to the boat.
Finally, compare the handover against the agreement and inventory. As a recommendation, record which documents, equipment and keys are delivered and what remains outstanding. Ask the adviser to confirm the ownership-transfer and administrative work allocated to each person. If a technical issue raises a safety question, obtain the relevant authority's or inspection body's assessment before sailing. The decree describes escalation for serious defects; this guide does not turn an informal reassurance into clearance to navigate with an unresolved regulatory problem.
Broker tip: As a practical handover check, compare the inventory and document list with what is actually delivered. Resolve inspection-status questions with the competent body before planning departure, and retain a written record of outstanding items. Your questions
Yes; the navigation document, official boat record and evidence of the actual sale answer different questions. The registration decree describes the record of registrable acts and the document showing principal characteristics and owner details. Ask a locally qualified adviser to assess ownership and charges for the particular yacht. As a practical recommendation, compare the identification information across the documents before making an unconditional offer. (BOE – recreational boat registration)
The Maritime Navigation Act requires a written vessel sale contract and extends its sale provisions to craft where their nature permits. Ask a locally qualified lawyer to confirm the application to your transaction, including any consumer or cross-border framework. As a practical recommendation, settle the inventory and agreed inspection conditions in the documents before committing money rather than relying only on an advertisement. (BOE – Maritime Navigation Act)
No; the Maritime Navigation Act distinguishes ownership acquisition by delivery from registration for third-party effect. The relevant administrative maritime records also need their separate assessment. Ask the adviser to identify the required documents and responsible person for each step. This guide does not establish that an ordinary signature alone completes every formality for every recreational yacht and flag arrangement. (BOE – Maritime Navigation Act)
The official guidance used here addresses first matriculation, rather than establishing a fresh charge for every resale. The history and intended use need a transaction-specific assessment, and separate purchase-tax questions remain. Give a qualified adviser the actual registration and sale information before relying on a seller's tax description. No universal total purchase-tax rate is asserted by this guide. (AEAT – maritime matriculation-tax scope)
No replacement is established by this guide. The statutory inspection framework uses a seaworthiness certificate recording required inspections and their future dates, with expiry where checks are not completed and passed in time. A private purchase survey needs its own instructions. Ask the competent authority or authorised inspection body to confirm the actual regulatory position before relying on the yacht being ready to depart. (BOE – recreational boat inspections)
This guide only includes facts checked against official sources. For anything it does not cover, email us at info@europeanyachtbrokers.com for the latest information, and ask a locally qualified adviser to confirm the position for your own boat.
