How to Import a Boat into Spain in 2027

Distinguish a temporary visit from permanent import and check the customs, conformity and Spanish registration paperwork.

By Peter Mattey · 9 min read · Facts checked 2026-10-03

Importing a boat Spain starts with the vessel's customs position and your intended use, not simply the port where it will arrive. A temporary visit, a permanent purchase and a move of habitual residence raise different questions. Buyers should resolve the route before committing to transport; sellers should establish which supporting documents they can supply. This guide explains the verified distinctions and practical checks without assuming that foreign registration proves the boat's tax or customs position.

The guide covers temporary-admission declarations, selected relocation VAT conditions and the documents relevant to Spanish registration and product conformity. It is intended for private buyers and sellers planning an international movement. Exact duty calculations, tax exemptions and eligibility should be confirmed for the actual vessel with customs or a locally qualified adviser. Section 1

Permanent import or temporary visit?

The first question is what you intend to do with the boat after it arrives. AEAT's traveller guidance describes temporary admission for non-Union means of transport followed by re-exportation. That is different from a purchase intended to remain in Spain. As a practical recommendation, explain the vessel's customs history, your residence and intended use to customs or an appropriately qualified adviser before arranging delivery. A statement that the yacht has a foreign flag does not, by itself, answer the customs procedure question.

The VAT Act distinguishes entry of non-Union goods and entry from a territory outside the relevant VAT territory. It also explains when placing goods under qualifying situations or customs regimes affects the point at which importation occurs. Those distinctions mean that the departure country alone may be an incomplete description. As practical advice, assemble previous import or customs documents, invoices and an explanation of the proposed route so an adviser can assess the actual transaction rather than applying an assumption based on the seller's location.

The Canary Islands are excluded from the harmonised VAT territory in the VAT Act. A route involving those islands therefore needs its own territorial analysis. This guide does not apply a mainland VAT assumption to every Spanish destination. As a practical recommendation, tell your adviser where the boat is now, where it will arrive and where it will be kept. Ask for the customs and tax treatment of that precise movement in writing before agreeing an unconditional purchase or paying for a delivery passage.

Broker tip: Practical recommendation: obtain a written route assessment before committing to delivery. Give the adviser ownership, residence, existing customs status and final destination together, and ask whether the plan is temporary admission or a permanent import. Section 2

Collect the registration and conformity documents

For Spanish registration of a CE-marked recreational boat, the registration regulation lists documents to accompany the application where applicable. These include declarations of conformity for the boat and propulsion engines, plus evidence of acquisition of ownership or the right to use the vessel. As practical advice, request the documents before making the purchase unconditional. Match the boat and engine identification to the paperwork and ask the maritime authority to confirm the route for the actual vessel rather than treating every imported yacht as administratively identical.

The same registration provision requires customs clearance where applicable for boats from third countries. It also calls for foreign deregistration evidence for an imported vessel previously registered elsewhere, or a responsible declaration where registration is not required in that country. As a practical recommendation, ask the seller to establish what can be supplied and when, then agree who will obtain any outstanding document. The existence of a purchase invoice does not answer the separate questions of customs clearance and removal from a previous register.

Conformity duties deserve attention before shipment. Under the current product requirements decree, a private importer must address the prescribed obligations if the manufacturer has not complied with conformity requirements. Where the manufacturer has not carried out conformity assessment, the private importer must use the applicable post-construction assessment procedure before putting the product into service. As practical advice, consult the maritime authority and an appropriate notified body about missing technical records. Do not assume that customs clearance resolves a separate product-conformity problem or makes a missing declaration unnecessary.

Broker tip: Practical recommendation: create a document checklist with the receiving maritime authority before shipping. Ask the seller for copies first, identify missing conformity or deregistration evidence, and agree responsibilities for obtaining it in the purchase terms. Section 3

Relocation relief, taxes and the decision timetable

Moving home can raise a different VAT question from buying a yacht abroad. The VAT Act provides relief for personal goods imported by an individual transferring habitual residence from a third territory, subject to conditions. These include residence outside the Community for at least 12 consecutive months before the move and, for ordinary non-consumable personal goods, use at the former residence for at least 6 months. As practical advice, ask an adviser whether the boat and your circumstances meet the complete relief conditions before relying on an exemption.

Relocation relief is not simply a declaration that the boat is personal property. The law requires the goods to serve the same purposes in the new residence and addresses their previous normal taxation. It provides a maximum import period of 12 months after the move, with a separate advance-import route subject to a commitment to establish residence within 6 months. As a practical recommendation, assemble dated evidence of residence, acquisition and actual use. Boats acquired under specified diplomatic or consular relief have a different prior-use condition, so those cases need particular checking.

Spanish flag registration is another administrative step. The registration decree requires the specified tax and fee evidence where applicable and states that the district maritime chief decides the flagging application within 1 month of submission; silence is treated as refusal. That statutory period is not a researched estimate of your actual completion time. As practical advice, ask the authority whether the application is complete and how any outstanding customs or conformity issue affects it before making a voyage plan depend on receiving the new documents. No universal customs-duty rate, import VAT calculation or matriculation-tax exemption is quoted; these require the vessel, transaction, origin, residence and destination to be assessed. Current consolidated EU temporary-admission eligibility exceptions and a boat-specific maximum stay were not fully verified; no universal duration is stated. For these, email us at info@europeanyachtbrokers.com for the latest information.

Broker tip: Practical recommendation: request a written tax assessment and a separate administrative timetable. Keep statutory conditions apart from an adviser's service quotation, and ask which evidence is still outstanding before fixing delivery and registration-dependent travel arrangements. Section 4

Temporary admission pitfalls and guarantees

For qualifying traveller means of transport, AEAT lists normal declarations, CPD carnets, oral declarations with the prescribed accompanying document, and declarations by an act treated as a declaration. These are conditional customs routes rather than an unrestricted choice for every yacht buyer. As practical advice, ask customs which procedure fits the vessel, user and intended stay. This guide does not state a universal temporary-admission duration or suggest that changing a registration flag resolves the conditions of a customs regime.

AEAT warns that customs may refuse simplified oral or deemed declarations where there is a serious risk of non-compliance and instead require a normal declaration with a guarantee. Its normal-declaration guidance allows electronic or paper submission and permits the traveller to act personally or through a customs representative. As practical advice, decide who will handle the declaration and make the supporting documents available to that person before arrival. Do not treat the absence of a complicated form in another owner's experience as evidence that your own case needs no customs assessment.

Where a guarantee is required, AEAT describes recognised forms including bank guarantees, surety insurance and a deposit, and explains that a cash deposit can be returned after the goods leave the Union customs territory. That is not a quoted service charge or an estimate of import tax. As a practical recommendation, obtain confirmation of the required guarantee, how discharge will be proved and who will retain the records. Keep the customs plan separate from the sale payment so that the purpose of each sum is clear.

Broker tip: Practical recommendation: ask customs to confirm the chosen regime, documentary evidence and discharge arrangements. Keep entry and exit records together and obtain advice before changing the ownership, use or intended destination while a temporary regime remains open. Your questions

Frequently asked questions

Is a temporary visit the same as permanently importing a boat?

No: AEAT describes temporary admission of qualifying means of transport followed by re-exportation, whereas permanent entry needs its own customs and tax assessment. As a practical recommendation, give customs the vessel's existing status, your residence and intended use together. Do not rely on the flag alone or assume that a procedure used for a holiday visit authorises a permanent purchase arrangement. (AEAT, temporary admission of means of transport)

What foreign registration document may Spain require?

For an imported boat previously registered elsewhere, the Spanish registration regulation requires foreign deregistration evidence or a responsible declaration that registration is unnecessary in that country, where applicable. It separately lists customs clearance for third-country boats. As a practical recommendation, establish before purchase what the seller can obtain and agree responsibility for outstanding records rather than relying only on the invoice. (BOE, recreational boat registration regulation)

Can moving home give VAT relief on my boat?

Personal-goods relocation relief can apply subject to the VAT Act's conditions. These include prior habitual residence outside the Community and prior possession or use requirements, with a different rule for specified diplomatically or consularly exempt recreational boats. As a practical recommendation, gather dated residence, acquisition and use evidence and ask a qualified adviser to assess all conditions before treating the movement as exempt. (BOE, VAT Act)

What if the imported boat has not had conformity assessment?

Where the manufacturer has not assessed conformity, the current product requirements decree requires a private importer to apply the relevant post-construction assessment procedure before putting the product into service. As practical advice, ask the maritime authority and an appropriate notified body to review the vessel's documents before shipment. Customs clearance and conformity assessment address separate questions and should not be treated as interchangeable approvals. (BOE, recreational craft product requirements)

Can I use a representative for a normal temporary declaration?

Yes: AEAT's normal-declaration guidance permits the traveller to declare personally or through a customs representative, with electronic or paper submission where that route is required. As a practical recommendation, agree who will assemble the vessel records and handle customs questions before arrival. Ask customs about any required guarantee and the evidence needed to discharge it rather than assuming every temporary entry follows the same procedure. (AEAT, normal temporary admission declaration)

What if my question is not answered in this guide?

This guide only includes facts checked against official sources. For anything it does not cover, email us at info@europeanyachtbrokers.com for the latest information, and ask a locally qualified adviser to confirm the position for your own boat.
