Can You Sell a Boat Privately in Spain? 2027 Guide

Plan evidence, agreement, payment and ownership notification for a private boat sale.

By Peter Mattey · 9 min read · Facts checked 2026-10-03

This sell a boat privately Spain guide starts by making the transaction understandable to someone who has never seen your boat. Good photographs help, but the important work is matching the advertisement, records, inventory and agreed handover. This guide combines verified official sale and registration provisions with clearly labelled practical recommendations. It does not supply unverified prices, tax rates, marina permissions or a universal checklist for every registration regime.

Private selling puts the organisation in your hands. Use the official rules to identify obligations, then agree the practical arrangements in writing. For legal scope, tax treatment and registration exceptions, confirm current requirements with the relevant authority or a qualified adviser before signing or accepting money. For anything this guide does not cover, email us at info@europeanyachtbrokers.com for the latest information.

Section 1

Prepare a private sale that buyers can assess

Our recommendation is to start a private sale with an evidence folder rather than an advertisement. Match the boat's identity to its registration papers, assemble maintenance invoices, list equipment and record known faults. These are practical preparation steps, not a statutory checklist for every vessel. A buyer should be able to distinguish what you know personally from what a previous owner told you. Describe missing records honestly, and make unresolved questions visible before somebody pays for travel or a survey.

Our recommendation is to photograph the boat as it stands, including machinery spaces and areas that need attention. Avoid claiming that equipment works unless you have checked it, and describe an inspection by its actual scope and date. A polished hull does not establish mechanical condition. Put your proposed inclusions and exclusions in writing early, especially removable navigation equipment, tenders and personal possessions. The maritime sale rules make the inventory significant; treating it as an afterthought can leave the parties with different expectations.

Our recommendation is to prepare a viewing plan with the marina before inviting strangers aboard. Agree access arrangements, retain control of keys and original documents, and avoid publishing identity numbers in an open advertisement. Ask prospective buyers what use they intend and whether the boat's documentation matches that use. Do not promise that an existing berth will accompany the sale without checking the marina's position separately. No official source reviewed here establishes automatic transfer of a private marina berth with the boat.

Broker tip: Our recommendation is to create one dated inventory and use it consistently in the advertisement, viewing discussions and final agreement. Mark each exception clearly rather than relying on recollection. A related question is answered in our guide on whether to use a yacht broker or a dealer in Spain.

Section 2

Negotiate price, inspections and payment conditions

Our recommendation is to separate the asking price from the terms that make an offer workable. Identify what the buyer may inspect, who arranges lifting or launching, and when a sea trial is permitted. Record who pays for each service and what happens if an inspection reveals a material concern. These arrangements need agreement; this guide does not treat a survey as universally compulsory. Obtain permission and appropriate insurance confirmation before somebody takes the boat out, rather than assuming the seller's existing cover extends to every trial.

Our recommendation is to have a locally qualified lawyer review the agreement before accepting a deposit. State how the deposit will be held, when it becomes payable to the seller and the circumstances in which either party may withdraw. The label used in a message is not a substitute for clearly agreed legal terms. Payment safety also requires independent checks: confirm bank details through a known contact route, investigate changes and ask your bank how it will confirm receipt. A payment screenshot is not your own bank's confirmation.

Our recommendation is to document any price adjustment after inspection as a signed variation. Avoid an informal promise to fix everything before collection without specifying the work and evidence of completion. Agree the condition in which the boat will be handed over and the point at which risk moves. Maritime law provides a default allocation around delivery, but the parties can agree otherwise. Align possession, keys, payment confirmation and the handover record so neither side has to infer what happened from an exchange of messages.

Broker tip: Our recommendation is to write inspection conditions before money changes hands. A short, specific agreement about costs, findings and withdrawal is more useful than an undefined promise to discuss problems later. See also our guide on what a yacht broker agreement in Spain should say.

Section 3

Separate the purchase price from the buyer's tax position

A private sale needs a tax review even when the parties agree a single headline price. The Spanish transfer-tax legislation identifies the acquirer as taxpayer for an applicable onerous transfer, regardless of a contrary agreement between the parties. That does not establish one nationwide rate for every boat sale. Our recommendation is to ask the competent tax authority or a qualified adviser to identify the transaction's treatment, filing route and evidence required before completion. Keep their answer with the sale file rather than substituting an online estimate.

Do not assume the word private determines every tax question. The transfer-tax legislation distinguishes supplies made in a business or professional activity and transactions subject to VAT from the onerous-transfer category, subject to its stated rules. A boat's previous use and the seller's actual capacity need checking. Our recommendation is to tell the adviser the registration, ownership history and intended transaction structure. This guide does not supply a VAT exemption, a regional transfer-tax rate or a seller's income-tax calculation without verified transaction-specific official support.

Our recommendation is to decide which records each party supplies for registration before signing. The ministry's version 10 transfer form calls for the document proving ownership and evidence of transfer tax, inheritance or gift tax, or VAT as applicable. That is a document requirement, not a statement that every tax listed is payable on a sale. Agree who obtains the relevant evidence and who keeps copies. A clear timetable helps prevent the parties from treating tax evidence as something to resolve after the boat has departed. No regional transfer-tax rate, seller income-tax calculation, brokerage commission or sale-price statistic verified; none stated. No automatic marina-berth transfer or universal survey obligation verified; practical arrangements are recommendations. For these, email us at info@europeanyachtbrokers.com for the latest information.

Broker tip: Our recommendation is to obtain the tax filing instructions for your actual transaction before completion. Do not turn a registration form's list of possible documents into a list of taxes always owed. Readers often go on to our guide on what goes in a boat sale contract in Spain.

Section 4

Complete handover and the registration notification

For boats within the relevant general registration regime, Royal Decree 1435/2010 gives the seller a notification duty: communicate the ownership transfer within a maximum of three months from the transfer. The buyer may also communicate it. Our recommendation is to agree who submits the paperwork, but keep the seller's responsibility visible in the completion checklist. An undertaking by the buyer is not evidence that the seller's own statutory duty has been met. Retain the submission acknowledgement with the signed contract and handover record.

The ministry's version 10 form includes a transfer declaration signed by the registered transferor and the new owner. Its stated validity is a non-extendable ninety days from submission, with navigation exclusively within the territorial sea and the new owner responsible as operator. The form also identifies accompanying documents and acknowledgement conditions. Our recommendation is to check those conditions before using this interim arrangement. It is not a universal permission for international delivery, and its ninety-day period must not be confused with the decree's three-month notification deadline.

Private sellers should not assume that accepting an inspection eliminates every later defect issue. Article 119 provides a specific maritime hidden-defect framework, extended to boats where their nature permits by Article 121: defects must be discovered within three months of physical delivery and notified reliably within five days of discovery. Article 120 gives a six-month period from notification for the resulting action. Our recommendation is to seek qualified legal advice about scope and any consumer rules, record disclosures accurately and preserve evidence of handover and later communications.

Broker tip: Our recommendation is to keep a completion file containing the contract, inventory, payment confirmation, handover record and registration submission acknowledgement. Check the boat's registration regime before relying on these general-regime instructions. Our guide on how yacht sale escrow works in Spain covers a related point.

Your questions

Frequently asked questions

Can I sell a boat privately in Spain?

A private sale still needs a written agreement under the applicable maritime sale provisions. Articles 118 and 121 establish the written-contract requirement and extend the sale rules to boats where their nature permits. Our recommendation is to identify the vessel, agreed inventory, price, inspection conditions and handover arrangements clearly, and have a locally qualified lawyer check the agreement's scope. (BOE)

Who pays transfer tax on a private boat sale?

The acquirer is the taxpayer for an applicable onerous transfer under Article 8(a). A contrary agreement between the parties does not change that statutory identification. Whether the transaction falls into that category and which filing requirements apply still need checking. Our recommendation is to obtain instructions from the competent authority or a qualified adviser rather than assume a national boat-sale rate. (BOE)

Must I notify the ownership change as seller?

Yes, under Article 17.3 of the relevant general registration regime the seller must communicate the transfer within a maximum of three months. The buyer may also communicate it. Our recommendation is to keep a submission acknowledgement and check that the boat actually falls within that regime, rather than treating the buyer's promise to deal with paperwork as proof of compliance. (BOE)

Can the transfer declaration cover an international delivery?

The ministry's version 10 transfer declaration states navigation exclusively within the territorial sea. Its non-extendable ninety-day validity from submission is subject to the form's acknowledgement and accompanying-document conditions. Our recommendation is to obtain specific confirmation before arranging any voyage that falls outside those limits; the declaration should not be described to a buyer as unrestricted permission to take the boat abroad. (Ministerio de Transportes y Movilidad Sostenible)

What should I know about hidden defects after handover?

The maritime provisions contain their own timetable where applicable to boats. Articles 119–121 provide discovery within three months of physical delivery, reliable notification within five days of discovery and action within six months from notification. Our recommendation is to obtain legal advice on the transaction's scope and any consumer provisions, and retain accurate disclosures and handover records instead of promising that inspection settles every claim. (BOE)
