THE EYB COUNTRY GUIDES · Spain
Identify the fee basis, payment event, expenses and consumer information before appointing a broker.
By Peter Mattey · 9 min read · Facts checked 2026-10-03
Yacht broker commission Spain should begin with the proposed appointment, not an assumed standard percentage. The person arranging a sale can provide different services and act under different contractual authority. The official rules used here describe mandate and commercial-commission remuneration and consumer information. They do not establish a universal yacht brokerage charge. Ask who owes the fee, how it is calculated and what event makes it payable before giving instructions or agreeing an appointment.
This guide distinguishes the charge for the service from expenses and money received on a client's behalf. It applies general legal provisions only within their stated scope, rather than treating every yacht intermediary as the same legal arrangement. A disputed entitlement or unclear appointment needs advice from a locally qualified lawyer. Key facts at a glance
Civil Code Article 1711 presumes a mandate gratuitous unless otherwise agreed, but presumes an obligation to pay where the mandatary's occupation is providing the relevant kind of service; applicability depends on the appointment's legal character. (BOE consolidation updated 3 January 2025.)
Boletín Oficial del Estado – Spanish Civil Code ·For an appointment within the commercial-commission regime, Article 277 requires the principal to pay the commission agent's remuneration unless otherwise agreed. (BOE consolidation updated 9 May 2023.)
Boletín Oficial del Estado – Spanish Commercial Code ·For applicable trader-consumer contracts, Article 60 requires prior information on the total price including taxes and charges, or the determination method where advance calculation is not reasonably possible. (BOE consolidation updated 28 February 2026.)
Boletín Oficial del Estado – Consumer and User Protection Act consolidated ·For commercial commission, Article 278 requires the principal to pay supported expenses and outlays, with legal interest from expenditure until full reimbursement. (BOE consolidation updated 9 May 2023.)
Boletín Oficial del Estado – Spanish Commercial Code ·Article 82 treats unnegotiated terms or unconsented practices as unfair where, against good faith, they cause a significant imbalance against the consumer. (BOE consolidation updated 28 February 2026.)

Ask the provider to describe the actual service and legal role before discussing its charge. A mandate, the Spanish contrato de mandato, involves work performed on another person's account or instructions. Commercial commission, or comisión mercantil, has its own statutory scope in the Commercial Code. These descriptions are not a licence to assume that every yacht marketing appointment falls within the same category. Have a locally qualified lawyer review an unclear arrangement and identify the contracting business and the person who will give instructions.
The Civil Code's mandate provision addresses the presumption of payment when the relevant service is the mandatary's occupation. The commercial provision separately addresses remuneration and its fallback where the amount is not expressly agreed. Neither point should be converted into a claimed yacht-specific percentage. As a practical recommendation, ask for the actual proposed fee in writing and clarify whether the calculation uses the final agreed boat price or another basis. Do not rely on a description such as the usual local commission.
Keep statutory scope separate from the terms you negotiate. Write down the party liable, the covered services and the event proposed to create payment entitlement. If the provider is introducing a buyer, negotiating on instructions or authorised to sign, identify those tasks individually. Those are practical recommendations for a clear appointment, not a verified standard brokerage contract. The opened sources do not establish a universal regulatory rate or a universal sale-completion trigger, so those limitations are recorded rather than filled from market practice.
Broker tip: Ask for the fee calculation and payment event in writing before instructing the broker. Identify the contracting role and the party liable, and have unclear legal scope checked by a locally qualified lawyer. See also our guide on what a yacht broker agreement in Spain should say.

Section 2
Where the appointment is a contract between a trader and a consumer, the Consumer and User Protection Act requires relevant prior information about the legal and economic terms. Its price provision addresses taxes, charges and the method of calculation where a price cannot reasonably be calculated beforehand. Ask the provider to connect that information to your actual appointment. Do not compare headline rates without checking the stated price basis, additional services and whether the amount shown includes the taxes applicable to the proposed service.
The consumer information provision also covers payment and performance arrangements and contract duration or termination conditions. Read those alongside the proposed commission trigger. A fee described as payable on sale is incomplete if the parties understand sale differently or if another clause creates an earlier obligation. As a practical recommendation, ask for a plain-language explanation of the event and record it in the appointment. If the document refers to another schedule, obtain that schedule before agreeing rather than accepting a promise to send it later.
Keep the evidence of the agreed terms and the later invoice. The consumer contract-document provision addresses a receipt, copy or other document with the essential conditions. That record helps both sides distinguish what was agreed from later changes requested during the transaction. The research does not establish a commission-specific tax percentage or a worked invoice total. Obtain the provider's transaction-specific calculation and qualified tax advice if the contracting entity, service location or customer status makes the treatment uncertain before arranging payment.
Broker tip: Compare the total proposed charge and the written payment trigger, not only the headline rate. Retain the appointment, referenced schedules and invoice so the agreed service and calculation can be checked together. Readers often go on to our guide on what it costs to sell a boat in Spain.

Section 3
Separate expenses from remuneration before the provider orders work. The Commercial Code's expense provision applies within commercial commission and requires a supported account. The Civil Code mandate provisions separately address necessary advances and reimbursement of faultless expenditure, including where the business did not succeed. These are scoped legal rules, not proof of a standard yacht advertising package. Ask which arrangement applies to the proposed appointment and write down the spending you authorise before assuming an unsuccessful marketing period leaves nothing to pay.
A practical spending schedule can identify each proposed service, who approves it and what documentation supports reimbursement. For photography, travel or another requested task, obtain the provider's own quotation rather than a supposed statutory price. Make clear whether the cost is included in the fee or separate. That schedule is a recommendation, not a national form verified here. No official standard package or expense allowance was established by the opened sources, so the guide does not invent one or calculate an illustrative legal invoice.
The accounting provisions address amounts received and the return of a principal's surplus within the relevant regime. If funds pass through the provider, request a clear account distinguishing authorised spending, remuneration and money held for another purpose. Do not assume an expense balance can automatically be taken from a purchaser's deposit. The appointment and any separate custody arrangement need examination on their own terms. A disagreement over deductions or an unreturned balance requires qualified advice using the actual documents and payment records. No official source establishing either a universal yacht commission rate or the universal absence of a regulated rate was verified; neither proposition is asserted. The appointment's legal category and payment trigger are transaction-specific; no universal completed-sale rule is asserted. Broker tip: Authorise specific spending in writing and ask for the supporting account. Keep expenses, the service fee and any client funds distinct so a sale that does not complete can still be reconciled clearly. Read cancellation and payment provisions together. Consumer law addresses unfair unnegotiated terms and certain restrictions on rights arising from nonperformance or defective performance. It also deals with one-sided termination and amounts retained for services not performed in the circumstances it describes. Those rules require the actual consumer and trader relationship to be identified. They do not mean every charge after cancellation is invalid. Ask a locally qualified lawyer to review a clause that is unclear rather than predicting a dispute outcome from its heading.
The Civil Code also says contract validity and performance cannot be left to one party's discretion. As a practical recommendation, identify any clause allowing the provider to alter the fee, determine its own payment trigger or decide a disputed deduction without a clear agreed process. Ask for an explanation and a revised draft where needed before signing. Preserve the proposal you received and the final accepted version so the fee arrangement can be assessed from the actual record rather than recollection.
Discuss what happens if instructions change, the boat is withdrawn or another intermediary becomes involved. The opened sources do not provide a universal answer for every brokerage arrangement, and this guide does not supply one. Record the proposed contractual treatment and obtain qualified advice on its enforceability and fit with the chosen role. Keeping the appointment clear at the outset is a practical way to reduce uncertainty for seller, buyer and provider without inventing a standard commission rate or an automatic entitlement in every case.
Broker tip: Read withdrawal, fee changes and disputed deductions before signing. Ask for the final agreed wording and retain the proposal history so an unclear charge can be reviewed against the actual appointment. A related question is answered in our guide on boat valuation in Spain.

Your questions
No standard yacht-specific percentage was verified from the official sources opened here. They provide scoped mandate and commercial-commission rules, including a fallback based on commercial usage where no express amount is agreed. Obtain the provider's actual proposal and record the payer, calculation basis and payment event. Do not treat another business's advertised charge or the fallback provision as a universal national tariff. (Boletín Oficial del Estado)
Yes where consumer-contract information duties apply: Article 60 requires the total price including taxes and charges, or the calculation method where advance calculation is not reasonably possible. Ask for the actual appointment's full price information and any additional services. This guide verifies no commission-specific tax percentage, so obtain a transaction-specific invoice calculation rather than assuming the headline rate is the entire amount payable. (Boletín Oficial del Estado)
Yes within the applicable scoped rules: commercial commission provides supported expense reimbursement, and the Civil Code mandate provision addresses faultless advances even if the business did not succeed. Discuss spending separately from remuneration and approve the proposed services in writing. Ask for supporting records and a reconciliation. The opened sources establish no universal yacht advertising package or fixed expense allowance. (Boletín Oficial del Estado)
No single legal category is established for every appointment by these sources. Civil mandate and commercial commission have distinct scope, so identify the actual service, authority and contracting parties. Ask a locally qualified lawyer to review an unclear arrangement before applying either rule. Practical written terms should state the calculation and payment event without claiming that a presumed industry percentage governs every intermediary. (Boletín Oficial del Estado)
The Civil Code says contract validity and performance cannot be left to one contracting party's discretion. Applicable consumer law also addresses unfair unnegotiated terms and the specified one-sided termination or rights restrictions. That does not decide every disputed fee automatically. Keep the appointment and payment evidence and obtain locally qualified advice on an unclear alteration, trigger or deduction before accepting the provider's interpretation. (Boletín Oficial del Estado)
