Are Yacht Brokers Regulated in Spain? 2027 Checks

Check the provider's legal identity, actual authority and applicable consumer duties without assuming a licence category.

By Peter Mattey · 9 min read · Facts checked 2026-10-03

Yacht broker regulation Spain should be checked through the provider's actual identity and activities. A trading name, an attractive website and a claimed professional status do not answer the same question as legal authority to act for an owner. The official sources used here establish general online-provider disclosure, mandate and consumer rules. They do not verify a universal yacht-broker licence or establish that no such licensing requirement can apply in a particular case.

This guide helps buyers and sellers examine the business, its authority and the documents for the proposed service. It separates verified legal duties from practical checks and from regulatory questions that remain unresolved. Ask the relevant authority or a locally qualified lawyer to review a claimed authorisation or an unclear appointment before relying on it. Section 1

Which business is providing the service?

Begin with the legal entity behind the service, rather than only the name on the yacht advertisement. The Information Society Services Act, Law 34/2002, requires specified provider information within its electronic-service scope. It addresses identity, direct contact, tax identification and applicable register details. As a practical recommendation, compare that information with the appointment and invoice. If the documents name different entities, ask who is contracting with you and who is responsible for the service before you agree instructions or payment.

The same Act has conditional provisions for authorised activities and regulated professions. These do not prove that every yacht intermediary has the same licence or belongs to a particular professional body. Ask the provider to identify the legal basis of a claimed authorisation and the authority that can confirm it. The sources opened here do not settle a universal yacht-broker licensing category. Avoid treating a private membership badge or a reference to another profession as official verification of the particular activity you are commissioning.

An official register entry, where applicable, and a valid contact route answer useful identity questions, but they do not guarantee that the provider can sign for the seller or protect purchase funds. Those questions need their own documents. Keep the legal entity, representative and proposed service consistent throughout the transaction. This is a practical checking method rather than a national due-diligence form. Obtain qualified advice if a claimed status cannot be connected to the relevant public record or if the contracting capacity remains unclear.

Broker tip: Match the website identity with the appointment and invoice before paying. Ask for the legal basis and verifying authority for any claimed authorisation, rather than accepting a badge or trading name as proof. Section 2

What authority does the intermediary hold?

The Civil Code defines mandate, contrato de mandato, as work performed on another person's account or instructions. That is a scoped contractual category, not an automatic description of every broker service. Identify whether the provider is only introducing a buyer, handling negotiations on instructions or proposing to sign or receive money for someone else. As a practical recommendation, ask to see the authority needed for the proposed act and have an unclear document reviewed by a locally qualified lawyer before relying on it.

Within mandate, broad administrative wording is distinguished from express authority for disposal, mortgage and other strict ownership acts. The prohibition on exceeding the mandate matters when a provider presents an offer as already accepted or gives a payment instruction in the owner's name. Ask who approved the specific action and keep the evidence with the transaction documents. Do not assume that being allowed to market a boat supplies unrestricted signing authority. The actual appointment and any separate power need to fit the proposed act.

The mandate rules also impose an accounting obligation for operations and received amounts. That does not establish a particular escrow scheme or the protection of any individual provider's client account. If funds will be received on another person's behalf, request the custody and release terms separately. Keep the account holder, authorised recipient and agreed payment purpose clear. The sources used here do not verify a universal mandatory client-money insurance requirement, so that claim is omitted rather than inferred from the provider's professional description.

Broker tip: Check the specific authority for each proposed act. Keep marketing instructions separate from powers to dispose, sign or receive money, and have unclear authority documents reviewed before treating the intermediary's instruction as the owner's. Section 3

When do consumer information duties apply?

The Consumer and User Protection Act defines the relationship within its scope. An individual acting outside business or professional activity can fall within its consumer definition, while the trader definition addresses business activity directly or through another person. Identify your actual status and the purpose of the service rather than assuming that every yacht transaction is consumer business. The brokerage service and the boat sale also need to be considered separately where different people contract to provide them. Obtain qualified advice if the status is unclear.

Where the consumer information duties apply, relevant legal and economic terms must be explained before the consumer is bound. The provision addresses clarity, accessibility and the language of the information. Ask the provider to connect those disclosures to the actual appointment rather than send an unrelated generic leaflet. A practical preparation step is to obtain the scope, price, duration and payment information together and compare them with the draft document. Record unanswered questions and resolve them before accepting rather than relying on later explanations.

The information duty does not turn every general commercial claim into verified competence or a guarantee of success. Ask who performs the proposed tasks and what the appointment actually covers. If the provider uses another person, identify the contractual responsibility for the service and preserve the relevant description. This guide does not establish a standard training certificate, survey qualification or universal brokerage licence. Confirm any claimed regulated status with the relevant authority and use locally qualified advice where the service crosses into another professional activity. No official universal yacht-broker licensing, mandatory training or specialist registration category was verified; absence of such regulation is not asserted. No universal mandatory broker client-money insurance or purchase-fund protection scheme was verified. For these, email us at info@europeanyachtbrokers.com for the latest information.

Broker tip: Identify whether you are contracting as a consumer and for which service. Obtain the actual appointment's prior information in an understandable form, and resolve missing scope or payment details before accepting it. Section 4

What records help if the service does not match the promise?

Consumer law addresses the effect of offers and advertising on the contract. Where it applies, service promises and offered conditions should not be dismissed merely because they are missing from the signed document. As a practical recommendation, keep the proposal, relevant advertisement and final agreement together. Identify the actual promise rather than assuming general praise guarantees a particular result. If the scope or advertised condition changes, ask for a clear explanation and preserve the revised version before deciding whether to continue with the appointment.

The statute requires documentary evidence of the consumer contract and addresses unfair unnegotiated terms. Keep the accepted general conditions and referenced schedules as well as the main signature page. A fee, withdrawal clause or limitation should be examined within the whole document and the actual consumer relationship. The legal rules do not supply the outcome of every disagreement automatically. A locally qualified lawyer can assess whether the actual term or conduct falls within the applicable unfair-term and performance-rights provisions using the preserved records.

If a complaint arises, describe the service agreed, the event that went wrong and the remedy you are asking the provider to consider. Those are practical recommendations, not a prescribed complaint form or a verified national brokerage response deadline. Preserve the original messages and payment evidence. Do not replace a contractual service complaint with an unsupported assertion that the business is unlicensed, and do not let a verified business identity be mistaken for proof that every service promise was fulfilled. Investigate each question on its own evidence.

Broker tip: Keep the proposal, advertising promise, accepted conditions and payment records together. Describe a complaint against the actual agreed service, and seek qualified advice rather than assuming registration settles contractual performance. Your questions

Frequently asked questions

Does this guide verify a universal Spanish yacht-broker licence?

No: the official sources opened here establish scoped identity, authority and consumer rules, but do not verify a universal yacht-broker licence or its absence. Ask a provider claiming authorisation to identify the legal basis and confirming authority. The online-service disclosure provisions are conditional where an activity is authorised or a profession regulated; they do not create a universal yacht-broker licence category. (Boletín Oficial del Estado)

What should I check in an online provider's identity?

Within the Information Society Services Act's scope, the provider must disclose the specified identity, contact, tax and applicable register information. Compare those details with the proposed appointment and invoice as a practical check. Ask for an explanation if the entities differ. Those identity disclosures do not themselves establish signing authority for the owner or protection of a purchaser's funds, which need separate evidence. (Boletín Oficial del Estado)

Does the intermediary need express authority to dispose of the boat under mandate?

Yes within the Civil Code mandate regime: generally worded authority covers administration, while disposal and other strict ownership acts require express mandate. The mandatary cannot exceed its limits. Have the specific document checked before relying on signing or disposal authority, and keep it separate from ordinary marketing instructions. The actual service must first be identified rather than classifying every yacht intermediary automatically as a mandatary. (Boletín Oficial del Estado)

Does consumer law apply to every yacht-related contract?

It applies to the consumer-trader relationships within the statute's definitions, rather than every transaction indiscriminately. Identify the purpose of the service and the actual contracting parties, including the distinction between a brokerage service and the boat sale. Where its scope applies, prior information and contract-document duties are relevant. Ask a locally qualified lawyer about uncertain status before applying consumer provisions to the appointment. (Boletín Oficial del Estado)

Can an advertised service promise matter even if omitted from the contract?

Yes where the consumer advertising provision applies: offered services, conditions and guarantees are enforceable even where absent from the signed document, with more beneficial contract clauses prevailing. Keep the actual proposal and advertisement rather than rely on memory. The provision does not establish every complaint's outcome automatically; use the records and qualified advice to assess the actual promise, service and terms. (Boletín Oficial del Estado)
