Are Yacht Brokers Regulated in Turkey? 2027 Checks

Check the intermediary's legal business, contractual duties and fee conduct without assuming a yacht-specific licence.

By Peter Mattey · 9 min read · Facts checked 2026-10-03

Yacht broker regulation Turkey involves several checks that answer different questions. Official commercial-register information identifies the contracting business, while the contract laws describe the intermediary's role and duties. Neither a company entry nor a brokerage label alone proves protected deposit handling or a yacht-specific professional authorisation. This guide explains the verified business and contract framework and identifies the licensing points that were not established from an official source, rather than treating a missing search result as proof of deregulation.

Buyers and sellers can use the guide to verify the entity, examine its appointment and ask precise questions about authority, fees and money. The sources are official register information and legislation. Practical recommendations are distinguished from legal duties; a locally qualified lawyer should address the actual contract and any cross-border service arrangement. Section 1

Verify the business before relying on the broker's brand

The Commercial Code requires a merchant to register the business and chosen trade name. It also requires the merchant to undertake business transactions and sign relevant documents under that trade name. Ask the intermediary for its full legal identity and compare the name with the appointment and invoice. As practical client advice, keep the trading brand in the marketing file and the legal entity in the contract file so a familiar logo does not conceal which person accepts the obligations.

The Code provides public access to commercial-register contents and allows certified copies at the requester's expense. That offers a way to check the identity information supplied by a business. Ask the responsible registry for the relevant record where the online result does not answer a signatory or company-status question. A business record answers an identity question. It should not be described as a yacht-specific licence, a surveyor qualification or evidence that the intermediary's account has a particular client-money protection.

The Ministry's central register system, MERSİS, provides electronic registration, amendment and deletion functions and stores commercial-register information. Use the full legal name and registry particulars when checking the entity rather than searching only a shortened yacht-brand name. As practical advice, compare the contract party, invoice issuer and proposed account beneficiary together. If a different company is receiving the payment, request its role and authority in writing before signing or transferring funds on the assumption that all connected businesses are interchangeable.

Broker tip: Ask for the legal name, registry evidence and signatory authority before appointment. Match those details to the proposed invoice and account beneficiary, and resolve differences before any money is sent. See also our guide on what a yacht broker agreement in Turkey should say.

Section 2

Check the role and the authority accepted

The Code of Obligations describes brokerage (simsarlık) as preparing or mediating contract formation. It applies mandate rules as the default to that relationship. A yacht intermediary's role should therefore be described by its actual service and the agreement, not only by the word broker. As practical review advice, ask whether the person is introducing parties, representing an owner or contracting in another capacity. Keep that explanation with the appointment so the buyer and seller can identify whom to approach about an offer.

The mandate rules determine unspecified scope from the nature of the work. They also require compliance with express principal instructions, with a stated exception for inability to obtain permission where consent would clearly have been given. As practical client advice, specify price authority and any reserved approval decisions. Ask the intermediary to provide the instruction trail if it says it can accept an offer or amend a term. The guide does not infer every sale-completion power from a general marketing appointment.

Where another person is to do the work, the mandate framework begins with personal performance and permits delegation in the circumstances the statute identifies. Read any cooperation clause and ask which business will report to the owner and arrange viewings. As practical oversight, identify the person making each decision before the parties depend on it. A group of associated yacht businesses can have different legal identities and responsibilities, so the appointment should explain the actual chain of authority rather than relying on a shared brand.

Broker tip: Request the appointment and actual owner instructions before relying on an intermediary's acceptance of a term. Ask who can approve price changes, delegate work and undertake each closing step. Readers often go on to our guide on how much yacht broker commission is in Turkey.

Section 3

Understand duties that can affect fees

The mandate framework requires loyal and careful performance in the principal's legitimate interests. Its care standard refers to prudent conduct in comparable work. As practical appointment advice, define how enquiries, offers and owner decisions are recorded and reported. That makes performance review more concrete than a broad claim of professional service. Keep the listing description and any revisions together, especially where information about condition or equipment is disputed, so the intermediary's work can be assessed against the agreed task.

The brokerage rule removes fee and expense rights where the intermediary acts in the other party's interest contrary to the undertaking or obtains a fee promise contrary to good faith. Ask for disclosure of representation and other remuneration before the appointment. Do not turn that rule into an unsupported claim that every service to both parties is automatically prohibited. A locally qualified lawyer should assess the actual undertaking and conduct. The reader can make the review easier by retaining the fee proposals and correspondence.

The Code ties brokerage-fee entitlement to a contract resulting from the intermediary's activity. Where the resulting contract has a suspensive condition, payment follows fulfilment of that condition. As practical advice, compare the fee trigger in the appointment with the sale terms before signing. If there is a dispute, preserve the introductions, offers and accepted agreement rather than deciding the question from an invoice alone. The guide does not publish a compulsory yacht commission percentage or a default market fee. No yacht-specific national licensing register, mandatory professional-insurance requirement or client-money compensation scheme verified. No single dedicated yacht-broker regulator or universal complaint route verified; do not infer absence of other applicable regulation. For these, email us at info@europeanyachtbrokers.com for the latest information.

Broker tip: Keep representations, other remuneration and the fee trigger visible in the appointment. Preserve the introduction and offer record so questions about conflicts or earned fees can be reviewed against evidence. Section 4

Check accounting and the limits of what is verified

The mandate provisions require the representative to give an account on request and hand over what was received in connection with the work. They also require interest on money whose delivery to the principal is delayed. As practical client advice, ask for a transaction statement explaining receipts, authorised deductions and remittances. Those duties do not, by themselves, verify a protected yacht-escrow scheme. Require the actual account and fund-holding terms before treating a marketing intermediary as an independent deposit holder.

The Code allows the principal and representative to end a mandate unilaterally, while making the party that ends it at an inappropriate time liable for resulting damage. It also addresses responsibility where a representative delegates without authority. If the appointment or conduct is disputed, collect the signed terms, ending notice and delegation evidence for local review. Practical complaint preparation should identify the actual legal business and the agreement rather than assuming that every yacht-broker complaint belongs to a single professional licensing body.

No yacht-specific national licence, compulsory professional insurance or client-money compensation scheme was verified from an official source for this guide. That research limit does not establish that no other rules apply. The verified commercial-register and contract duties remain relevant, but a claim of specific authorisation needs its own official evidence. As practical advice, ask the broker to identify the asserted authorisation, issuing authority and current record, then have a locally qualified adviser assess what it covers for the proposed service.

Broker tip: Ask for the official evidence behind each licence or insurance claim. Retain the signed appointment, business identity, transaction statements and correspondence so a locally qualified adviser can examine the actual service. Your questions

Frequently asked questions

Does a commercial-register entry prove yacht-broker licensing?

No yacht-specific licensing conclusion follows from the commercial-register evidence used here. The Code provides business registration and public inspection, and MERSİS stores registry information. Ask for the official record behind any separate professional-authorisation claim. The absence of a verified yacht licence in this guide is a research limit, not proof that every possible authorisation requirement is absent. [Official Legislation Portal; Ministry of Trade]

What legal duties are verified for the intermediary?

The Code's brokerage framework applies mandate provisions as the default. Those include scope, instructions, loyalty and care, delegation and accounting. The actual service and appointment still need to be examined before deciding how the provisions apply. Preserve the owner's instructions and the broker's records so a locally qualified adviser can compare conduct with the accepted work. [Official Legislation Portal]

Is every broker allowed to hold a buyer deposit?

No general protected fund-holding permission was established from these sources. The mandate accounting rule does not itself prove an escrow or client-money compensation scheme. Ask for the actual holder's identity, authority, account terms and release instructions before sending a deposit, and obtain local advice where the claimed protection cannot be independently evidenced. [Official Legislation Portal]

Can conflicts affect commission rights?

Yes. The brokerage provision removes fee and expense rights where service to the other party contradicts the undertaking or a fee promise is obtained contrary to good faith. Ask for other remuneration and representation to be disclosed, then preserve the evidence. The rule should be applied to the actual conduct, rather than treated as a blanket prohibition on every contact with both parties. [Official Legislation Portal]

How can I check the business behind the website?

Ask for its full legal name and registry details, then use official commercial-register evidence. The Code permits public inspection and certified copies, while MERSİS stores business-register information. Compare the entity with the appointment, invoice and account beneficiary before payment. That identity check should be kept separate from assessing the claimed fee or deposit protection. [Official Legislation Portal; Ministry of Trade]
