THE EYB COUNTRY GUIDES · Croatia
Follow the Croatian ownership-change filing, original-document requirements and checks on mortgages and registration status.

Boat ownership transfer Croatia involves more than handing over keys and a sale receipt. For a Croatian registered craft, the Ministry assigns the ownership-data change request to the new owner and explains how the supporting documents must reach the Harbourmaster's Office. Buyers need to distinguish that process from first registration after an import or deletion for a change of flag. Sellers also need a record showing who will carry out the filing after the agreed completion event.
This guide covers Croatian registered boats and yachts, including the written transaction document, register evidence, submission route and administrative decision periods. It helps both parties prepare questions for the Harbourmaster's Office and a locally qualified lawyer. It does not determine title formalities under a foreign register or the tax treatment of the sale. Start with the actual registration record, rather than the marina location or flag shown in a photograph. The Ministry's boat and yacht instructions distinguish a change to an existing Croatian entry from the first registration of an existing foreign craft. Our recommendation is to obtain the current vessel identity and registration evidence, then confirm the intended route with the competent Harbourmaster's Office. Do not prepare a simple ownership-change request where the craft is actually leaving a foreign register and needs a different registration bundle.
The register folio separates technical data, ownership and encumbrances. Our recommendation is to compare the seller's name and the vessel identity across the ownership record and the proposed agreement, then review the restriction record with the lawyer. The Ministry describes Sheet C as covering mortgages and other proprietary restrictions, including relevant leases, charters, pre-emptive rights and disposal restrictions. A clean-looking registration certificate should not replace that review. Resolve any third-party right or restriction before deciding what the buyer is receiving and how completion will be arranged.
Identify who is signing for each party and prepare the transaction document required for the proposed entry. The Ministry requires a written legal transaction with a certified signature of the person whose right is transferred. Our recommendation is to ask the Harbourmaster's Office to confirm the acceptable authentication for the document before signature, particularly where it will be executed abroad. Separately, the Civil Obligations Act addresses a seller's responsibility for undisclosed third-party rights that limit the buyer's right. Documentary compliance and the substantive title checks should therefore be reviewed together.
Broker tip: Our recommendation is to obtain the ownership and restriction evidence before finalising the transfer document. Ask the lawyer and Harbourmaster's Office to resolve the signing authority, authentication route and any release documents together. See also our guide on how to register a boat in Croatia.

Section 2
The new owner must request the ownership-data change after acquiring ownership rights. The Ministry gives the same filing period for boats and yachts. Our recommendation is to prepare the request before completion and assign responsibility for signing, submitting and retaining evidence of the bundle. The transaction file should identify the date from which the filing responsibility is being managed. Do not assume that the broker's circulation of the agreement or the seller's delivery of the boat automatically submits a request to the register.
The Ministry describes a digital submission route: the completed signed request and supporting material can be sent to the competent office by email as scanned documents. That route has an explicit limit. Documents forming the basis for ownership and encumbrance entries must be supplied as originals, and other supporting documents can be supplied as notarised copies. Our recommendation is to ask the office to identify the original documents needed for this ownership change and arrange their physical delivery alongside the email submission. Keep the submitted bundle and delivery evidence together.
For a foreign owner, check the representative arrangements before submitting the request. Ministry instructions require the relevant power of attorney if the owner lacks a registered representative meeting the stated scope. The published yacht guidance describes a document co-signed by the representative and the person granting authority, including their identities, addresses and personal identification numbers. Our recommendation is to use the authority's instructions for the actual case and distinguish this registry representation from a broker's commercial mandate. Do not assume that authority to market the boat satisfies every registry representation requirement.
Broker tip: Our recommendation is to prepare an email bundle and a separate original-document delivery checklist. Confirm the representative's authority before completion and retain the full submission record so follow-up questions can be answered from the same file. Section 3
The Ministry publishes decision periods measured from receipt of a duly delivered request. It distinguishes the ordinary decision route from a case requiring an investigation. Our recommendation is to use those published periods for administrative planning and ask the office whether the submitted request is complete. They should not be presented as an appointment guarantee or as a promise that a deficient bundle will be accepted. Keep the buyer's travel and delivery plans flexible until the authority has clarified the individual submission and any remaining requirements.
The registration sheet is issued without charge according to the current Ministry instructions. That statement should not be expanded into a claim that every transfer service is free. The same guidance identifies other documentary expenses in a first-registration context, including translation, notarisation, apostille and foreign deletion evidence. Our recommendation is to establish which documents this transaction actually needs and obtain quotations from the relevant providers. An ownership change within the Croatian register and a first entry following a foreign purchase should not be assigned the same unsupported package cost.
Ongoing ownership expenses also remain separate from the transfer itself. The Ministry identifies annual maritime-domain and navigation-safety fees after registration, alongside additional operating costs such as berthing and insurance. Our recommendation is to reconcile the sale's agreed expense allocation with the craft's actual account records and the buyer's intended use. The guide does not provide an all-inclusive transfer tax figure or a promise that the seller's berth or insurance arrangements continue automatically. Obtain case-specific answers before adding an estimated operating budget to the agreed purchase price. A universal all-inclusive ownership-transfer fee or tax total was not verified. The published decision periods do not verify actual appointment availability or typical local processing delays. For these, email us at info@europeanyachtbrokers.com for the latest information.
Broker tip: Our recommendation is to ask the office whether the request is duly delivered before fixing onward plans. Keep document-service quotations, registry charges and ongoing ownership expenses separate in the completion file. Our guide on whether you pay VAT on a boat in Croatia covers a related point.

An ownership change in the Croatian register and deletion from that register are distinct routes. The Ministry permits removal at the owner's request but states that mortgage creditors must consent if the craft is mortgaged. Our recommendation is to confirm the proposed flag and registration outcome before deciding which application belongs in the sale bundle. If deletion is intended, ask the lawyer and Harbourmaster's Office to identify the necessary lender documentation. Paying the seller alone does not demonstrate that a registered creditor has consented to the craft leaving the register.
The Ministry gives the previous owner a specific response if the buyer does not request the ownership change within the stated period: the previous owner can request removal from the register. Our recommendation is for both parties to agree how filing evidence will be shared and who follows up on any authority questions. Keep that undertaking in the transaction file without treating it as a replacement for the buyer's filing responsibility. A seller should have a dated record of completion and a clear contact for the subsequent administrative work.
The authority's decision also has a defined review route. Ministry instructions say an appeal against the Harbourmaster's register decision is unavailable, while an administrative proceeding can be initiated within the specified period after receipt. Our recommendation is to take a refused or disputed application promptly to a locally qualified lawyer, with the full request, original-document record and decision. Separately, the Act requires delivery at the agreed time and place. Record physical handover clearly so a later register question does not leave the parties unable to establish what was delivered and when.
Broker tip: Our recommendation is to agree how the buyer will share filing evidence after handover. If deletion or lender consent is involved, have the necessary documents checked before committing to an onward registration plan. Your questions
No. For a Croatian registered craft, the new owner must request the ownership-data change. The Ministry's instructions describe the signed request and the supporting originals needed for ownership and encumbrance entries. Our recommendation is to prepare that filing alongside the sale agreement and record who submits it after completion. Physical handover should be documented separately so the transaction file shows both the delivery event and the administrative follow-through. (Ministry of the Sea, Transport and Infrastructure)
No. The electronic route permits submission of the request and suitable scans, but the Ministry requires original documents supporting ownership and encumbrance entries to be delivered by post or in person. Our recommendation is to ask the office which originals are needed for the individual change before signing. Keep their delivery evidence with the email submission so a missing original can be identified without rebuilding the entire bundle. (Ministry of the Sea, Transport and Infrastructure)
The Ministry's yacht instructions require the prescribed power of attorney where a foreign owner submitting a registration request lacks a registered representative with the required scope. The published document instructions identify the co-signatures and party details. Our recommendation is to confirm the arrangement with the Harbourmaster's Office before completion. A commercial brokerage mandate should not be assumed to provide the separate registry representation required by the authority. (Ministry of the Sea, Transport and Infrastructure)
The Ministry requires mortgage creditors' consent for removal of a mortgaged yacht from the register. Our recommendation is to review the restriction record and proposed registration outcome before choosing the application route. Where the buyer intends a flag change, ask the lawyer and Harbourmaster's Office to identify the lender and deletion documents together. A completed payment to the seller does not itself establish that the creditor has given the required consent. (Ministry of the Sea, Transport and Infrastructure)
No. The Ministry measures the ordinary and investigation decision periods from receipt of a duly delivered request. Our recommendation is to ask the office whether the bundle meets that requirement and resolve any missing original documents promptly. Do not treat the published administrative period as proof of appointment availability or an undertaking to accept a deficient application. Arrange travel and onward plans using the individual authority response. (Ministry of the Sea, Transport and Infrastructure)
