THE EYB COUNTRY GUIDES · Croatia
Separate brokerage remuneration, document services, delivery expenses and the costs of agreed repairs before accepting an offer.
By Peter Mattey · 9 min read · Facts checked 2026-10-03
Boat selling costs Croatia should be built from the services and obligations of the individual transaction. Brokerage remuneration, preparation work, authenticated documents and delivery can affect the seller's net proceeds, but they do not form a verified universal package. Croatian law addresses when a broker earns commission and whether expenses can be recovered. Ministry instructions identify registration documents and continuing ownership costs. The practical task is to obtain the actual quotations and agree who bears each cost before accepting the offer.
This guide is for sellers budgeting a Croatian boat sale and buyers negotiating expense allocation. It explains the official default rules and the limits of the published information. It does not quote competitors' commission percentages, invent a sale tax total or treat first registration after an import as an ordinary domestic ownership change. Read the broker mandate before calculating the sale proceeds. The Civil Obligations Act describes brokerage as bringing the principal into contact with a person who will negotiate the contract, with commission payable if the contract is concluded. Our recommendation is to obtain a written remuneration clause that identifies the service, the payment event and the person responsible for payment. A selling-price estimate is not a complete budget if the separate brokerage agreement remains unread or if either party assumes that every marketing expense is included in the same amount.
The Act recognises a broker's entitlement to commission even where remuneration was not expressly agreed, and provides a judicial determination route if its amount is not established by a tariff, another general act, agreement or custom. Our recommendation is to settle the amount and calculation basis explicitly instead of leaving a disagreement for later. The official provisions opened here do not establish a universal yacht brokerage percentage. Ask the broker to explain the quoted amount and any separate service charges in the actual written mandate.
Commission and expense recovery are distinct. The Act makes commission due on conclusion of the brokered contract unless agreed otherwise, with a separate rule for a suspensive condition. It permits expense reimbursement where agreed, including where no contract results. Our recommendation is to ask how the mandate treats survey conditions, withdrawal and unsold marketing expenditure before authorising work. Keep the remuneration clause and expense authorisations in the same budget file so the seller can identify both the sale-dependent payment and costs that remain payable without a completed transaction.
Broker tip: Our recommendation is to obtain the remuneration amount, payment trigger and authorised expense categories in writing. Keep a separate list of costs payable if the sale does not complete before authorising photography, lifting or marketing services. Section 2
Establish the register route before ordering document services. Ministry instructions require a written legal transaction with a certified signature of the person whose right is transferred when ownership is acquired through that transaction. Our recommendation is to ask the Harbourmaster's Office to confirm the document and authentication route, then obtain the provider's quotation. Do not assume that a broker's prepared agreement, a translated copy and an authenticated original are interchangeable deliverables. The budget should identify the actual service needed and the party who will pay for it.
The Ministry identifies translation, notarisation, apostille and removal-certificate expenses in its first-registration guidance. Our recommendation is to determine which of those services this sale actually requires instead of adding them all to every Croatian ownership change. A craft entering from a foreign register needs a different documentary assessment from a boat staying in the same register. Request itemised quotations and record what they include. No standard notarial, translation or foreign-registry deletion fee is asserted here because those amounts were not verified for the individual transaction.
The current boat instructions state that the registration sheet is issued free of charge. That specific statement does not establish that every service surrounding a sale is free. Documents supporting ownership and encumbrance entries must be delivered as originals by post or in person despite the electronic request route. Our recommendation is to include the agreed document-delivery arrangements in the completion checklist and obtain any necessary delivery quotation. Separate the authority's published statement from the charges of people preparing, authenticating or physically delivering the bundle.
Broker tip: Our recommendation is to confirm the documentary route before requesting quotations. Describe each service and deliverable by name, then record who orders it and who pays instead of relying on an unspecified administration allowance. Section 3
The Civil Obligations Act supplies a default division of delivery-related expenses, subject to a different agreement. Our recommendation is to decide what counts as the agreed handover and specify any boat movement, loading, transport or onward delivery the parties want included. Keep the seller's delivery obligations distinct from the buyer's subsequent removal arrangements. The actual invoice allocation should follow the final written terms, rather than the assumption that the person who books a service necessarily bears its cost or that every delivery task is included in the selling price.
Ownership also carries costs while the sale is being prepared. Ministry instructions identify annual maritime-domain and navigation-safety and pollution-protection fees after registration, and flag berthing, inspections, insurance and other additional costs. Our recommendation is to gather the craft's current account records and ask each provider how the agreed completion date affects the account. The guide does not establish automatic refunds or transferable contracts. Keep ongoing ownership bills separate from transaction quotations so the seller can see which expenses already exist and which will arise only if the sale proceeds.
The Act places accidental loss or damage risk on the seller until delivery under its general sale rule, subject to its stated exception. Our recommendation is to align the handover event with the insurer and the completion terms rather than treating the first buyer payment as an automatic end to every responsibility. Record who authorises survey movements or repairs before that event. This guide does not provide an insurance premium or an assumed liability allowance. Obtain answers for the actual boat and planned activity before booking services that change its location or use. No universal brokerage percentage, survey price, repair contingency or all-inclusive selling-cost total was verified. Tax liability and individual provider charges require case-specific assessment; no worked fee total is possible without verified applicable amounts. Broker tip: Our recommendation is to separate existing ownership accounts from new sale-service quotations. Agree the delivery event and expense allocation in the contract, then ask providers about the actual account consequences of that event. Survey findings can lead to negotiated repairs or a revised offer, but a quotation should identify the work rather than merely promise that the boat will be ready. Our recommendation is to record the fault, the chosen response, who instructs the provider and who pays before completion. The amended Civil Obligations Act provides defect remedies, subject to its conditions, including repair, replacement, price reduction and rescission. A repair budget negotiated during the sale is therefore separate from a legal determination that a particular defect gives the buyer a remedy.
Where the Act's repair or replacement remedy applies, the amended provisions require the work to be free of charge, within a reasonable time from notice and without significant inconvenience, considering the thing's nature and purpose. They also address the seller's cost of collecting the item. Our recommendation is to have a locally qualified lawyer assess a contested defect before either party assigns liability or pays a remedial invoice on an assumption. The guide does not convert every survey recommendation or maintenance observation into a statutory repair claim.
Current repair rules can also affect the period of defect responsibility after work is performed. The latest amendment introduces a once-only extension following repair and distinguishes commercial contracts. It excludes contracts concluded before the repair provisions' commencement. Our recommendation is to retain the contract date, defect notification and repair record so the lawyer can identify the relevant version and consequences. This is a reason to document completed work accurately, rather than to add an invented contingency percentage to every seller's budget or assume that repaired machinery settles every future responsibility.
Broker tip: Our recommendation is to record the agreed repair scope, provider and payment responsibility beside the survey finding. Retain the contract date and completed-work evidence so any later defect issue can be assessed using the correct rules. See also our guide on how to prepare a boat for sale in Croatia. Your questions
The opened brokerage provisions do not establish a universal yacht commission percentage. They address entitlement, the payment event and how an unspecified amount can be determined. Our recommendation is to obtain the actual amount and calculation basis in the written mandate before budgeting the net proceeds. Keep any authorised expense reimbursement separate, particularly where it remains payable even without a concluded sale. No competitor's quoted rate is used here. (Narodne novine)
Yes, where expense reimbursement has been agreed. The Act permits agreed brokerage expense recovery even if the intended contract is not concluded. Our recommendation is to read that clause before authorising services and ask the broker to identify the expense categories and ordering process. Treat that exposure separately from sale-dependent remuneration so the seller can understand what remains payable if the proposed transaction falls away. (Narodne novine)
No. The Ministry's free-of-charge statement concerns the registration sheet. The guidance also identifies documentary service costs in a first-registration context and requires physical delivery of originals supporting ownership and encumbrance entries. Our recommendation is to confirm which services this transaction actually needs and obtain itemised quotations. Do not add every import-related document service to a domestic ownership change or describe provider charges as a registry tariff. (Ministry of the Sea, Transport and Infrastructure)
The Act's default expense rule assigns removal and subsequent expenses to the buyer unless the parties agree otherwise. Our recommendation is to specify the planned delivery and onward movement in the contract, then allocate each quoted service explicitly. Keep that expense decision separate from the booking arrangements: the person placing an order should be able to identify the agreed payer and the service covered by the quotation. (Narodne novine)
The guide does not establish that every survey recommendation creates a seller-paid statutory repair obligation. The amended Act gives defect remedies subject to its conditions, while buyers and sellers can separately agree preparation work during negotiation. Our recommendation is to record the finding and the agreed response, then obtain legal review where liability is disputed. A maintenance suggestion and a legally actionable defect should be assessed from the actual evidence. (Narodne novine)
