THE EYB COUNTRY GUIDES · Croatia
Separate foreign-owner representation from sale-signing authority and plan remote originals, filing and any registry deletion.
By Peter Mattey · 9 min read · Facts checked 2026-10-03
Selling a boat non-resident Croatia requires a clear plan for who can act and where the original papers will go. The Ministry's instructions contain specific rules for foreign owners of Croatian-registered vessels, while the Civil Obligations Act governs the scope of a contract-signing mandate. This guide keeps those roles clear so an owner abroad can prepare a documented sale without assuming that a local contact already has authority to conclude it.
The guide focuses on Croatian register procedures for foreign owners and sale coordination from abroad. Residence and nationality are distinct, and it does not decide an owner's tax residence. A locally qualified lawyer should assess the mandate, signing form and destination-register requirements before the parties fix completion. The Ministry's foreign-owner instructions require the registration power of attorney set out in the Maritime Code when a foreign individual or company owns a Croatian-registered boat. That representative arrangement supports the vessel's eligibility and administrative dealings. Our recommendation is to locate the actual document and check the person currently recorded before starting the sale. Being resident abroad and having foreign nationality are different matters; the guide applies this specific foreign-owner rule only where the owner falls within the Ministry's stated category.
The prescribed document is co-signed by the owner and authorised representative. It includes their full names and permanent addresses, or company names and registered seats, together with personal identification numbers. The Ministry says these signatures do not need certification by a signature-certifying authority. Our recommendation is to check that the information remains correct and that a change of representative has been handled with the registry. Do not turn that stated administrative signature rule into a conclusion about signing the sale contract.
If a foreign owner fails to provide a valid prescribed power, the Ministry says the vessel does not meet the registration requirements. It also requires that power for later registration requests, apart from removal, where no qualifying representative is already registered. Our recommendation is to resolve a missing or inadequate administrative authorisation before relying on an ownership-change application. A letter limited to receiving documents is expressly distinguished in the guidance and should not be assumed to fulfil the broader requirement.
Broker tip: Our recommendation is to retrieve the current administrative power and registered representative details before negotiating completion. Ask the harbour master's office to resolve missing or outdated information, and have the sale-signing authority checked separately. Foreign owner power
Section 2
An owner abroad can consider appointing someone to handle the transaction, but the contract-signing mandate needs its own assessment. The Civil Obligations Act says the representative may undertake only the transactions authorised by the power of attorney. Our recommendation is to have a locally qualified lawyer specify the intended sale, price authority, signing role and handling of documents. A marina caretaker, broker or registered administrative representative should not be treated as authorised to conclude the sale merely because they already assist with the boat.
The Act applies the legally prescribed form of a contract or other transaction to the power authorising it. It also limits a general power to ordinary business and calls for special authority for transactions outside that scope. Our recommendation is to have the lawyer determine the form and scope needed for the actual vessel sale before the owner signs abroad. This guide does not invent a universal apostille requirement or say that every foreign notarisation will be accepted by the Croatian registrar.
Unauthorised signing is a practical completion risk. The Act binds an unauthorised represented person only if that person later approves the contract, and it permits a grantor to narrow or revoke the power. Our recommendation is to check the operative mandate with the owner shortly before completion and retain the relevant authority documents with the signed agreement. If authority changes, inform the people coordinating the sale promptly and ask the lawyer to assess its consequences before releasing the boat or original ownership evidence.
Broker tip: Our recommendation is to send the lawyer the actual mandate before arranging travel or remote signing. State who may agree the price, sign the transfer and deliver documents, and confirm that authority remains operative at completion. Section 3
The Ministry allows registration requests through its digital platforms, appropriate digital delivery, direct delivery and post. That choice of starting route does not remove the original-document requirement. Documents supporting ownership and encumbrance-sheet entries must reach the competent office as originals; other supporting documents can be notarised copies. Our recommendation is to agree a document route with the office and the buyer before the owner leaves Croatia or sends papers from abroad. An emailed contract scan is useful for preparation but is not a substitute for the required original.
Identify the vessel clearly in every subsequent application. The Ministry requires its identification number, name or both on requests other than first registration. Our recommendation is to check those details against the register and use the same identity in the contract and filing cover note. The new owner must request the ownership change within 30 days of acquiring ownership. Give the buyer the papers needed for that task and agree how filing evidence will be sent back to the seller abroad.
Completion planning should allow for the authority's decision rather than equate sending an email with obtaining registration. The yacht instructions give a decision period of 30 days after a duly delivered request, or 60 days where an investigation is conducted. Those are the stated administrative periods for that source, not a promise that a private sale completes within them. Our recommendation is to distinguish the contractual handover date, original-document delivery and registry decision, particularly where the owner or buyer is arranging travel. No individual non-resident income tax, VAT result or tax-residence determination is asserted. The foreign-owner rules do not automatically apply to every Croatian citizen living abroad; citizenship and residence are distinct. Broker tip: Our recommendation is to agree who delivers each original and obtain evidence that the competent office received it. Keep the buyer's filing date and the authority's decision separate from the boat's contractual handover record. See also our guide on how to register a boat in Croatia.

A sale to a buyer using another flag needs a considered registry route. The Ministry allows removal at the owner's request, while a mortgaged yacht requires creditor consent for removal. Our recommendation is to ask the lawyer and buyer's registrar which evidence will be needed and how it will be obtained before signing completion terms. Do not assume the existing registration disappears when the sale price is paid or that a new owner can resolve a creditor's rights simply by presenting the contract.
Where an existing boat is brought from a foreign register into the Croatian register, the Ministry requires a certificate of removal from that foreign register among the first-registration papers. That direction-specific requirement should not be treated as the complete rule of a different destination country. Our recommendation is to have the buyer obtain the destination registrar's requirements and coordinate them with the Croatian deletion process. Keep the old register, proposed new register and parties responsible for each document clear in the transaction file.
The Ministry states that the registration sheet is issued free of charge but also identifies translation, notarisation, apostille and removal-certificate expenses among documentary costs for first registration. It does not publish a universal overseas-sale package price on these instructions. Our recommendation is to request actual quotations for the documents needed in the individual case and state who pays them. Non-resident tax treatment, foreign-exchange bank charges and document acceptance abroad need their own assessment rather than an invented flat completion allowance.
Broker tip: Our recommendation is to obtain the destination registrar's document list and actual certification quotations before agreeing the seller's costs. Coordinate mortgage clearance and removal evidence with the buyer's proposed registration rather than promise an automatic flag change. Your questions
That should not be assumed. The Ministry's prescribed foreign-owner power concerns registration, while the Civil Obligations Act limits a representative to the legal transactions actually authorised. Our recommendation is to have the lawyer inspect the operative mandate and specify sale-signing authority separately. A person who receives documents, maintains the boat or assists with the registry is not thereby shown to have authority to conclude your contract. (Narodne novine — Civil Obligations Act)
The Ministry says signatures on its prescribed foreign-owner registration power do not require signature certification by an authorised certifying authority. That statement concerns the specified administrative document. Our recommendation is to have the lawyer assess the separate sale-signing power and the ownership document, since the Act applies the prescribed transaction form to its mandate. Do not extend the administrative rule to every paper signed abroad. (Ministry of the Sea, Transport and Infrastructure — boat instructions)
Not where an original is required. The Ministry accepts digital starting routes but requires originals for documents supporting ownership and encumbrance entries, with other papers permitted as notarised copies. Our recommendation is to agree the original-document delivery route before the parties leave the handover meeting or send papers from abroad, and retain evidence that the competent office received the required documents. (Ministry of the Sea, Transport and Infrastructure — boat instructions)
The Ministry requires mortgage creditor consent for removal of a mortgaged yacht. Our recommendation is to coordinate that consent, the owner's removal request and the buyer's destination-register requirements before completion. Payment of the purchase price and presentation of the sale contract do not themselves establish that the creditor has consented or that a different registrar will accept the resulting papers. (Ministry of the Sea, Transport and Infrastructure — yacht instructions)
No. It establishes the sourced administrative and representation rules described here, including foreign-owner powers, original documents and registry routes. Tax residence and nationality are different matters, and no individual non-resident tax result is asserted. Our recommendation is to obtain a separate locally qualified tax assessment before pricing the transaction, while the lawyer checks the mandate, contract and any document acceptance needed abroad. (Ministry of the Sea, Transport and Infrastructure — yacht instructions)
