Prepare a Sardinian boat sale around its actual location, documents, condition and registered ownership process.
By Peter Mattey · 9 min read · Facts checked 2026-10-03
Selling a boat Sardinia works best when the buyer receives a precise location and an honest account of what is ready for inspection. A listing that says Olbia or Cagliari still leaves practical questions about the actual marina, yard, access and boat documents. This guide uses official port information to distinguish local areas, then explains the national seller duties and registered ownership process. It does not invent seasonal demand, berth shortages or local processing delays.
The guidance is for an owner preparing a recreational boat sale in Sardinia and for a buyer checking the handover plan. Practical suggestions about access and scheduling are recommendations, not port rules. Arrange permissions and service bookings with the actual operator, and obtain qualified advice where title or contract questions arise. Key facts at a glance
The Sardinian port authority identifies Olbia's inner port, Porto interno, as the area intended for recreational boating.
Sardinia Port Authority – Olbia, updated 21 Sep 2026 ·The authority distinguishes Cagliari's historic port, used for commercial, Ro-Ro, passenger and cruise traffic, from its channel port serving transhipment and Ro-Ro traffic.
Sardinia Port Authority – Cagliari, updated 21 Sep 2026 ·Article 1477 requires delivery of the titles and documents relating to ownership and use of the thing sold.
Normattiva – Article 1477, updated 19 Apr 1942 ·Article 17 of the Codice della nautica da diporto, Legislative Decree 171/2005, requires publicity of ownership acts for craft subject to registration within 60 days of the act, or 120 days if the interested person resides abroad, through ATCN transcription and a licence annotation.
Normattiva – Article 17, updated 10 May 2026 ·The ministry says a STED historical search can reveal annotations, including administrative detention measures on an ATCN-registered craft.

Give the actual marina or yard name, the boat's position and the agreed meeting point before anyone travels. Official port descriptions show why a city name alone is not enough. The Sardinian port authority distinguishes Olbia's inner recreational port from the commercial and passenger areas. That is useful orientation, not a permission to enter a particular berth or a guarantee that every service is available there. Confirm visitor access and the contact responsible for opening the boat with the actual operator.
In Cagliari, the authority distinguishes the historic port from the channel port and describes their different commercial functions. A buyer should not infer a yacht's precise location from those broad descriptions. As a recommendation, send a location pin and the operator's own access instructions alongside the viewing confirmation. If the craft is ashore, state that clearly and agree how the buyer will inspect it safely. Avoid booking travel around an assumed launch, lift or sea-trial appointment that the operator has not confirmed.
Keep the regional information specific without turning a sale guide into a transport brochure. The official pages opened here do not establish current berth pressure, peak-season waiting lists or standard yacht-sale delays. Ask your own operator about available appointments and access arrangements for the proposed date. As a seller, organise the viewing around the boat's actual condition and location rather than promising a rapid sale because it is in Sardinia. Describe local arrangements you have confirmed, and leave unsupported market claims out.
Broker tip: Send the precise marina or yard location and the operator's access instructions before the viewing. Confirm any lift or launch booking separately, so the buyer's travel plan follows a real appointment. Our guide on how to prepare a boat for sale in Italy covers a related point.

Prepare a document folder and an equipment inventory while the boat is being readied for viewings. Article 1477 of the Italian Civil Code requires the seller to deliver ownership and use documents, and it deals with the condition and accessories at delivery. As a recommendation, identify the originals available and any missing record that needs attention. A buyer arriving for a short visit should be able to see the paperwork relevant to the boat rather than wait for a later explanation.
State which equipment stays on board and which personal items will be removed. The Civil Code's delivery rule allows the parties to express a different intention about included accessories, so write the actual arrangement clearly. Use the inventory to support the description and avoid changing it casually after agreement. If the boat remains in a yard during the sale, record its condition with dated photographs and obtain consent before altering equipment that the buyer has agreed to acquire with the boat.
Explain known defects before the parties settle the sale terms. Article 1490 of the Italian Civil Code addresses faults affecting intended use or appreciably reducing value, and it restricts warranty exclusions where defects were concealed in bad faith. A practical disclosure should identify the fault and the available evidence, such as a repair record or inspection report. Do not present an unresolved issue as completed work. For an inspection and any proposed remedy, agree the arrangements in writing and obtain locally qualified advice where needed.
Broker tip: Prepare the ownership documents, inventory and defect disclosures together. Send legible copies before the buyer travels, while keeping the original documents ready for the agreed inspection and eventual handover. A related question is answered in our guide on boat valuation in Italy.

Section 3
Selling from a Sardinian berth does not replace the national filing rules for a registered recreational boat. Article 17 of the Codice della nautica da diporto, Legislative Decree 171/2005, requires publicity through the central recreational-craft archive and an annotation on the navigation licence. The archive is the Archivio telematico centrale delle unità da diporto, abbreviated ATCN. Agree who will submit the transfer documents, keep the act's date clear and ask the receiving counter which residence-based deadline applies in your transaction.
The electronic leisure-boating service counter is the Sportello telematico del diportista, or STED. Its filing receipt substitutes for the navigation licence during the update. The current statute also provides an all-purpose receipt arrangement when the prescribed construction and import declaration accompanies it. This declaration is the dichiarazione di costruzione e importazione, abbreviated DCI. Ask the counter to explain the documents issued for your craft and keep them together rather than relying on an older account of the interim arrangement.
The statutory correction process following a detected publicity breach is separate from the ordinary filing deadline. Avoid the problem by naming the person responsible for submission and obtaining evidence of the completed update. No current island-wide transfer cost or standard processing time was verified in this research. Obtain an itemised transaction quotation from the selected professional and ask the marina or yard separately for the services you actually book. Do not combine unverified charges into a purported normal cost of selling in Sardinia. Sardinian berth availability, seasonal demand, comparable sale prices, regional paperwork delays and marina-contract transfers are not covered here: email us at info@europeanyachtbrokers.com for the latest information.
Broker tip: Arrange the filing responsibility before the handover date. Keep submission evidence and the final updated record, and ask for an itemised transaction quotation instead of relying on an unsupported island-wide cost estimate. National deadlines

A tidy berth and a well-presented boat do not establish the legal position of the registered craft. The ministry describes ATCN as containing technical and legal information and identifies the central registry office, UCON, as checking registrations, transfers and annotations. Use the record to investigate the seller's ownership position before agreeing the completion plan. As a recommendation, compare the identifiers on the boat and its documents, and ask a locally qualified lawyer to review an unexplained right or a disputed ownership claim.
The historical-search service can reveal recorded annotations, including administrative detention measures. The ministry says it can be obtained through any STED in Italy without attending the office of original registration. This is useful when the owner lives outside Sardinia or the buyer is arranging enquiries before travelling. Ask the selected counter to explain the result and any further evidence needed. Do not assume a lender's interest has ended solely because the seller says the finance has been repaid or produces an informal payment receipt.
Coordinate the registry checks with the document and handover schedule. If a problem appears, resolve it before the parties treat the sale as ready for completion. The operator's berth arrangements should also be discussed separately: this research does not establish a right to transfer a marina contract automatically with the boat. Obtain the operator's own confirmation for the buyer's intended stay. Keep the sale agreement, filing plan, boat documents and locally confirmed access arrangements consistent so the buyer receives the boat on the agreed basis.
Broker tip: Request the historical record early and ask about every unexplained annotation. Obtain the marina operator's separate confirmation of the buyer's intended berth arrangements instead of treating the existing berth as automatically included. Your questions
No: give the actual marina or yard and its confirmed access instructions. The official Olbia page distinguishes the recreational inner port from commercial and passenger areas, while the Cagliari page distinguishes historic and channel-port functions. Those descriptions orient the visitor but do not identify the yacht's berth or grant access. Confirm the meeting point and the boat's ashore or afloat status with the operator. (Autorità di Sistema Portuale del Mare di Sardegna)
The national rule used here is Article 17 of the Codice della nautica da diporto: it requires publicity of ownership acts for craft subject to registration through ATCN and a navigation-licence annotation. The applicable deadline depends on the interested person's residence, rather than the Sardinian berth location. Ask the filing counter to identify the applicable case and agree who submits the transaction documents. (Normattiva)
Article 1477 requires delivery of titles and documents relating to ownership and use of the thing sold. Prepare them before agreement and identify missing originals early. The same article addresses delivery condition and included accessories unless the parties intend otherwise. A written inventory and document schedule are useful practical ways to record the handover, alongside a clear disclosure of known defects. (Normattiva)
Only describe condition you can support: Article 1490 requires warranty against defects affecting intended use or appreciably reducing value, and a warranty exclusion is ineffective for bad-faith concealment. Record known faults plainly and distinguish completed work from unresolved issues. Give the buyer the available records and agree the inspection arrangements. Do not substitute an unsupported assurance for an accurate description of the boat. (Normattiva)
Yes: the ministry says a historical search is available through any STED in Italy without visiting the original registration office. It can expose recorded annotations, including administrative detention measures. Request it early and ask the counter to explain the result before the parties agree completion. Resolve unexpected rights or title questions with appropriate professional advice rather than treating the boat's physical presentation as proof of ownership.
