How to Transfer Boat Ownership in Italy (2027)

Understand the registry process, ownership checks and responsibilities when an Italian-registered boat changes hands.

By Peter Mattey · 9 min read · Facts checked 2026-10-03

Boat ownership transfer Italy starts with identifying the boat's actual registration status and the people entitled to sell it. A signed sale document, delivery of the keys and an updated registry record are different parts of the transaction. This guide explains how to connect them without treating a small unregistered craft like a registered yacht, or assuming that an owner living abroad must automatically change the boat's flag.

The guidance covers the national recreational-craft framework, the central register and the filing receipt issued during an update. It also explains the separate domicile rules for owners abroad. Practical suggestions are recommendations for organising the sale; disputed title, foreign deeds and tax treatment need a locally qualified adviser. Section 1

Does this boat need a registry transfer?

Start by asking the seller for the current registry and navigation documents, then compare the recorded identity with the boat itself. An advertisement, a marina invoice or a flag flying from the stern does not establish the administrative status you need for the sale. Under the Codice della nautica da diporto, Legislative Decree 171/2005, Article 27, the treatment of a natante, the statutory small-craft category, differs from that of a registered recreational vessel. Confirm which regime actually applies before preparing the filing.

Voluntary registration deserves particular attention. A seller can describe a craft as small enough to remain outside compulsory registration while it is already entered in the central archive. Article 27 gives voluntarily registered natanti the legal regime of registered recreational boats. As a practical check, ask for the archive record rather than deciding from the hull dimensions alone. The filing professional can then explain whether the proposed transaction needs a registered ownership update or a different documented handover.

Missing purchase paperwork is a problem to resolve before a buyer commits. Article 27 provides a particular declaration route for voluntarily registering a natante when its ownership title is unavailable. That route has prescribed authentication and content; it is not permission to invent a replacement bill of sale. Ask the seller to establish how ownership will be evidenced and ask the receiving office to confirm the appropriate route. Keep the tax question separate because the provision expressly preserves applicable tax rules.

Broker tip: Ask for the boat's actual archive status at the outset. A small hull can still be voluntarily registered, so its size alone does not tell you which ownership process to follow. A related question is answered in our guide on how to register a boat in Italy.

Section 2

Who handles the ownership record?

The leisure-boating electronic service counter is the Sportello telematico del diportista, abbreviated STED. It acquires the documents used for registry operations. The central recreational-craft archive is the Archivio telematico centrale delle unità da diporto, or ATCN. Its central registry office, UCON, checks registrations, transfers and annotations. These are different roles within the same system. Ask the selected counter who will collect your documents, who will submit the transaction and how the parties will receive evidence of the completed update.

A historical archive search is useful before the sale document is finalised. The ministry explains that the service exposes recorded annotations, including administrative detention measures. As a recommendation, compare the search with the seller's identity, the boat identifiers and any financing explanation. A clean-looking navigation licence is not a substitute for investigating an unexpected annotation. If the records raise a title or security question, involve a locally qualified lawyer before releasing the purchase balance or accepting a proposed cancellation arrangement.

The historical-search service is available through a STED elsewhere in Italy, so you need not assume that every enquiry must go back to the original registration office. That flexibility can help a seller who lives away from the boat or a buyer organising a purchase remotely. It does not remove the need for accurate documents. Send legible copies for advance checking, agree who supplies originals and obtain the counter's transaction-specific list rather than relying on another owner's previous sale.

Broker tip: Request the historical search before finalising the handover plan. Ask the filing counter to explain each annotation and to identify any release document needed from a lender or another rights holder. See also our guide on what goes in a boat sale contract in Italy.

Section 3

What are the filing deadlines and interim documents?

For registered recreational craft, Article 17 of the Codice della nautica da diporto connects the ownership act with public recording in ATCN and an annotation on the navigation licence. The deadline is a filing obligation, not a promise that the authority will finish every application within that interval. Agree which interested party or authorised professional will lodge the documents. Record the act's date carefully and have the office confirm which residence-based deadline applies to the person requesting publicity in your transaction.

The filing receipt matters while the navigation licence is being updated. The current Article 17 distinguishes the ordinary substitution by the STED receipt from the all-purpose substitution supported by the prescribed technical declaration. The construction and import declaration, or dichiarazione di costruzione e importazione, is abbreviated DCI. Ask the counter what it will issue for this specific craft and keep the necessary documents together. Do not copy an old online description of the receipt period into a sale agreement.

A missed publicity obligation has a specific regularisation process once the breach is detected, with a consequence for the navigation licence if it is not corrected. Avoid letting the parties assume that the other person has filed. Obtain the submission evidence and then the updated documents. This research does not establish a complete current transfer invoice or a standard processing time. Ask for an itemised quotation separating official charges, authentication, taxes and the service provider's own fee before arranging completion. Transfer taxes, authentication charges, STED service fees and foreign-deed or flag-change documentation are not covered here: email us at info@europeanyachtbrokers.com for the latest information.

Broker tip: Set a named person responsible for filing and another checkpoint for receiving the updated documents. Keep the receipt and any prescribed DCI with the boat documents during the interim period. Readers often go on to our guide on whether you pay VAT on a boat in Italy.

  • Late filing consequence

Section 4

What changes when an owner lives abroad?

Residence abroad is relevant to the filing deadline, while domicile arrangements are a separate registration question. Article 18 of the Codice della nautica da diporto covers foreign owners and citizens living abroad who wish to register or maintain registration in Italy. A sale to someone abroad therefore needs a clear decision about the buyer's intended registry. Ask that question before the deed is prepared; retaining Italian registration and moving the boat to another flag need different administrative planning and supporting advice.

Foreign individuals and foreign companies without an Italian domicile have the consular or representative options stated in Article 18. Italian and other European Union citizens residing abroad have their own provision for electing domicile or appointing a representative. Do not describe these routes as interchangeable without checking the buyer's circumstances. The representative's status also matters. Have the filing professional explain the applicable clause, confirm the representative's eligibility and record where official communications concerning the registered boat will be received after completion.

The law expressly addresses the effect of the prescribed domicile on a foreign company's permanent-establishment status. That narrow rule should not be stretched into a promise about all corporate taxes, VAT or customs treatment. The seller should also keep a copy of the completed transfer evidence rather than relying on the buyer's intention to register later. For a foreign deed, company authority or planned flag change, obtain transaction-specific guidance from the relevant office and, where needed, a locally qualified lawyer.

Broker tip: Ask the buyer about the intended flag and residence before drafting the sale document. Confirm the representative and communication address early, rather than discovering a missing domicile arrangement at the filing stage. Your questions

Frequently asked questions

Does every small boat need an ownership entry in ATCN?

No: Article 27 excludes natanti and personal watercraft from compulsory registration, but a voluntarily registered natante takes the registered-boat legal regime. Check the actual archive status before deciding how to document the sale. For voluntary registration without an ownership title, the article supplies a prescribed authenticated declaration route, with specific ownership and purchase details. It does not displace applicable tax provisions. (Normattiva)

Must I use the boat's original registration office?

No: the ministry says a historical search can be obtained through any STED in Italy without visiting the original registration office. That search helps you examine recorded annotations before agreeing the transfer. Ask the selected counter how it will handle your transaction and what documents it needs. The central registry office, UCON, verifies the relevant registrations, transfers and annotations from STED documentation. (Ministero delle Infrastrutture e dei Trasporti)

How soon must the registered transfer be filed?

Article 17 requires publicity within 60 days of the act, or 120 days when the interested person resides abroad. Publicity comprises ATCN recording and a navigation-licence annotation. This is the statutory obligation to publicise the act, rather than a guaranteed processing time. Agree who will lodge the paperwork, retain submission evidence and arrange to receive the updated licence when the process is complete. (Normattiva)

Can the filing receipt replace the navigation licence?

Yes: Article 17 says the STED submission receipt substitutes for the navigation licence until it is updated. With the prescribed DCI technical declaration, it substitutes for all purposes until update, for no more than 90 days. Ask the counter to identify the documents applicable to your craft and keep them together. Do not assume the technical declaration is optional for the all-purpose provision. (Normattiva)

Can someone living abroad retain Italian registration?

Yes, Article 18 provides domicile arrangements for owners abroad who register or maintain registration in Italy. The relevant route depends on whether the owner falls under the foreign-person or company provision, or the provision for Italian and other EU citizens residing abroad. Representative status must also meet the applicable clause. Confirm the buyer's circumstances with the filing professional before choosing the retained-registration route. (Normattiva)

What does an ownership transfer cost in Italy?

This guide does not set transfer taxes, authentication charges or service fees, because they depend on the boat and the transaction. Email us at info@europeanyachtbrokers.com for the latest information, and ask for an itemised quotation.
