THE EYB COUNTRY GUIDES · Turkey
How Turkish register status affects the deed, supporting documents, payment and handover.
By Peter Mattey · 9 min read · Facts checked 2026-10-03
Boat ownership transfer Turkey involves more than paying the agreed price and collecting the keys. The first question is which register holds the vessel and which authority accepts the transfer. A yacht in the Turkish ship register, a small craft in the binding register and a foreign-flagged yacht cannot be treated as the same administrative case. This guide separates the official procedures from practical completion planning for buyers and sellers.
The official ship-transfer rules and harbourmaster checklists explain the documents and signatures to prepare. They do not supply a universal completion timetable or current total cost. Use the guidance to organise the file, then have the receiving authority confirm the requirements for the actual vessel before payment is released. Begin with the original registration document and the exact recorded owner. The Turkish Commercial Code deals expressly with a vessel entered in the ship register. Its transfer rule requires an agreement between the owner and buyer and transfer of possession. For practical planning, give the authority a copy of the certificate and ask it to identify the applicable procedure. Do not choose a closing method from the yacht's physical location alone; the registration category controls which documents the authority expects.
For a ship-register transfer, the ownership agreement has to be written and the signatures notarised. The Code also allows that agreement to be made at the ship registry office. Buyer and seller should choose the intended route before arranging travel or releasing funds. As a practical safeguard, ask the registry to check the proposed execution method, including a representative's authority, rather than assuming a privately signed sales agreement will satisfy the formal transfer requirement.
The binding register (Bağlama Kütüğü) has its own harbourmaster procedures. Istanbul's checklist describes that service for private craft and for commercial craft below the stated tonnage category. Its online application route should not be presented as the ship-register rule or as a procedure for all foreign-flagged boats. Where the certificate does not make the route clear, obtain a written answer from the receiving office. That clarification should come before the parties finalise their completion arrangements.
Broker tip: Ask the receiving authority to identify the register and execution route from the certificate itself. Keep that answer with the sale file so both parties plan the same completion procedure. Our guide on how to register a boat in Turkey covers a related point.

Istanbul publishes a clear application sequence: submit the request through the Umurbey maritime citizen portal, wait for review and approval, then select the appointment after the approval message. Its sale applications have a document-upload stage after the initial request. The office states that it cannot view an incomplete application. Practical preparation therefore starts with a complete digital file, rather than with a booked flight or a promise that the authority will complete the transfer immediately.
Çeşme's binding-register sale checklist asks both parties for original identification and a copy. For foreign nationals it specifies passport and residence-permit documents; for companies it specifies company documents. These are that office's published requirements, not a statement that every foreign buyer can register every kind of vessel. Have the intended office confirm buyer eligibility and representation before the sale contract becomes unconditional. Send legible copies first and retain the originals for the authority's own checks.
The seller's file also contains the original binding-register licence. Çeşme asks for vessel photographs and an engine serial-number photograph, allowing the documentation to be tied to the physical craft. For practical purposes, compare the document particulars with the hull and engine before submitting the images. If an engine has been changed or a vessel name is being altered, describe the change openly to the authority instead of trying to complete the sale against an outdated record.
Broker tip: Create a single document index showing which original is held by the seller, buyer or representative. Send the receiving office a readable copy set before committing to an appointment. A related question is answered in our guide on what goes in a boat sale contract in Turkey.

The published Istanbul sale procedure requires an original tax-office licence-duty receipt in the buyer's name for qualifying private vessels. Treat that as an instruction about who the receipt identifies, not as a complete schedule of sale costs. Obtain the current amount from the office using the yacht's recorded length and intended licence period. The page's monetary examples are labelled for an earlier year, so this guide does not reuse them as current charges.
Çeşme states that qualifying vessels at or above its length threshold are subject to binding-register licence duty. It also identifies exemptions for fishing vessels and vessels used commercially in sea transport. A pleasure yacht should not be placed within an exemption because the seller uses the word commercial informally. Give the authority the recorded vessel type and use, and ask it to confirm the applicable charge. Keep the original receipt in the appointment file after the payment is made.
For a ship-register vessel, the Commercial Code requires changes to recorded particulars to be notified to the registry by petition. It also requires presentation of the ship certificate when ownership changes. Buyer and seller should agree who submits the petition and collects the updated evidence. As practical closing advice, distinguish the deed, possession handover and updated certificate in the completion checklist. Record what has actually been done rather than calling the transaction administratively complete after a payment alone. No current total transfer cost or guaranteed national processing time verified. Local binding-register checklists must be confirmed with the receiving harbourmaster; ship-register and foreign-flag cases are separate. Broker tip: Ask for a current written charge calculation and identify who pays each item in the contract. Keep duty receipts separate from the purchase-price receipt and brokerage invoice. See also our guide on whether you pay VAT on a boat in Turkey.

The Commercial Code says that, unless the parties agree otherwise, the buyer of a registered ship acquires the seller-owned accessories existing at transfer. That makes the inventory worth reviewing with the same care as the deed. As practical advice, list the tender, navigation equipment, loose safety items and any excluded personal belongings. Give borrowed or leased equipment its own entry. A photograph is useful evidence of presence, but the parties should also identify who owns the item.
The Code separately addresses accessories that are not owned by the seller or are burdened by another person's rights. It refers those cases to the relevant Civil Code rules instead of treating possession as unrestricted ownership. Avoid promising clean title to everything aboard just because it is included in a listing photograph. Ask the seller to identify financed or third-party equipment and obtain local legal advice on its release before incorporating it into the buyer's final inventory.
A sale while the registered ship is on a voyage also has a statutory default: voyage profits and losses pass to the buyer unless the contract says otherwise. If delivery follows signing, ask a locally qualified lawyer to align the possession arrangement with the parties' intentions. Separately, Çeşme requires tax and chamber records when the buyer intends commercial use. A change of owner and a change of operating use therefore deserve explicit attention in the completion file.
Broker tip: Attach an agreed inventory and a signed handover record to the sale file. Resolve borrowed equipment, ongoing voyages and changes of use before the buyer accepts the documents. Readers often go on to our guide on how yacht sale escrow works in Turkey.

Your questions
Payment alone does not satisfy the ship-register transfer rule. The Commercial Code requires owner and buyer agreement and transfer of possession, with a written ownership agreement and notarised signatures or execution at the registry office. Identify the vessel's register first, then align payment and handover with the formal route confirmed by the receiving authority. [Official Legislation Portal]
Istanbul states that the sale application is not visible to the harbourmaster until the documents are complete. Its sequence runs from the portal request through review and approval to appointment selection. Prepare readable identity, licence and vessel evidence before relying on an appointment to complete the sale; that published sequence is not a promised completion time. [Istanbul Harbourmaster]
Istanbul requires the buyer's name on the original licence-duty receipt for the qualifying private-vessel sale. This identifies the receipt holder, but it does not settle every cost allocation between the parties. Obtain the current charge and record the contractual payer, then bring the original receipt with the other documents required for the appointment. [Istanbul Harbourmaster]
The registered-ship rule transfers accessories owned by the seller unless the parties agree otherwise. That does not make a borrowed or third-party-owned tender the seller's property. Identify ownership and exclusions in the inventory, then have the parties agree what is included before signing and handing over possession. The Code treats third-party rights separately. [Official Legislation Portal]
Çeşme's binding-register checklist specifies passport and residence-permit documents for foreign nationals. It also asks both parties for identity originals and copies. Use that checklist as the published local document requirement, then ask the intended authority to confirm registration eligibility and representation for the actual buyer and vessel; the checklist is not a universal foreign-flag transfer procedure. [Çeşme Harbourmaster]
