Can a Non-Resident Sell a Boat in Portugal? 2027

Organise the owner's evidence, representative powers and the correct registration route before handover.

By Peter Mattey · 9 min read · Facts checked 2026-10-03

Selling a boat non-resident Portugal requires a clear record of the owner, the boat and the person authorised to complete the sale. Living abroad does not replace the need to identify the relevant registry and transaction route. Official Portuguese registration rules specifically address owners resident outside Portugal, while DGRM explains its ownership-transfer service. This guide connects those requirements with practical arrangements for a seller who cannot attend every local step.

The guide covers a sale involving the Portuguese recreational-registration regime. It does not treat the boat's location as proof that this is the route for every foreign-flag craft. Establish the current registration and proposed buyer arrangements first, then obtain local advice for cross-border tax, customs or disputed-title questions. For anything this guide does not cover, email us at info@europeanyachtbrokers.com for the latest information.

Section 1

Which identity and ownership evidence should be organised?

Start with the current boat document and evidence identifying the seller. For the Portuguese regime, the registration law distinguishes individual and corporate owner details and specifically includes address evidence for an individual resident outside the country. As a practical recommendation, review those details before accepting an offer and explain discrepancies to the adviser handling completion. A different address, changed name or inconsistent owner entry should be resolved in the document file rather than left for the buyer to discover at handover.

Where a company owns the boat, the law addresses the entity identifier and commercial-certificate access, with an equivalent document for a company registered abroad. As a practical recommendation, establish who can commit that entity and supply the evidence required for the proposed signatures. Keep the company documents connected to the boat's ownership record. A person who manages visits or maintenance locally should not automatically be presented as the owner's authorised signatory without examining the relevant powers.

The law requires evidence of acquisition of title and changes the registration when ownership is transmitted. As a practical recommendation, assemble the documents describing the actual craft and the seller's interest in it. Tell the adviser about any shared ownership, financing or other unresolved title question before the contract is signed. The administrative owner-identification rules do not by themselves settle a disputed claim or prove that every right affecting the boat has been cleared for the intended sale.

Broker tip: Compare the owner's details with the boat record early. Prepare overseas address or foreign-company evidence as relevant, and flag unresolved ownership questions before signing. Our guide on whether you pay VAT on a boat in Portugal covers a related point.

Section 2

How can someone act for an owner who is abroad?

A local representative needs powers that fit the proposed act. The Civil Code calls the voluntary grant of representative powers a procuração, or power of attorney, and ties its form to the transaction's required form unless law provides otherwise. As a practical recommendation, ask the lawyer preparing the sale whether representation is needed and what wording and form fit it. Do not assume an informal message granting permission for viewings also authorises sale signatures or receipt of the purchase price.

Third parties can require proof of representative powers and a signed copy where those powers are documented. As a practical recommendation, supply the buyer and transaction adviser with the appropriate evidence before the representative commits the owner. Define whether that person may negotiate conditions, approve changes, sign or authorise payment. Keep any limit on price or terms visible. An owner abroad should be able to understand the proposed commitment and retain a record of the instruction given.

If representation lacks powers, the Code makes the act ineffective against the supposed principal unless ratified. It also addresses permitted substitution and notification of changed or revoked powers. As a practical recommendation, ask who will actually attend completion and recheck the document if that person changes. Agree how the seller receives the final documents and account. Avoid arranging travel or handover around an assumption that anyone associated with the local broker can use the same authority.

Broker tip: Have the proposed signing and payment powers reviewed before departure. Identify the actual representative and retain the final instructions and documents remotely. A related question is answered in our guide on how to transfer boat ownership in Portugal.

Section 3

Who submits the Portuguese ownership-transfer request?

DGRM's service for registration of an ownership transfer identifies the future owner or that owner's legal representative as the applicant. As a practical recommendation, agree with the buyer who will prepare and submit the request and how completion evidence will reach the overseas seller. Keep the administrative filing distinct from signing the sale and physical delivery. A seller abroad should know which actions are complete and which remain outstanding, rather than receiving only a general confirmation that everything is being handled.

The service uses BMar, the Electronic Maritime Desk, and lists the boat document still in the seller's name and acquisition evidence. As a practical recommendation, make legible copies available and identify the originals the buyer will receive at handover. DGRM also provides representative declarations for the specified applicant roles. Confirm the current form and submission requirements directly before filing, especially if a corporate representative is involved. A form for one administrative role should not be treated as a general sale power.

The underlying registration law specifies owner-identification and acquisition evidence for an owner change, with electronic submission through BMar. As a practical recommendation, check that the intended service fits the craft's current registration and whether other changes are being requested at the same time. Do not use this simple-transfer guide as a complete flag-change procedure. If a foreign registry, cancellation or another jurisdiction is involved, have the responsible authority establish the correct route before the buyer plans to depart. No universal non-resident seller income-tax or capital-gains result was verified. No permission to sell a temporarily admitted craft or automatic tax exemption is asserted. For these, email us at info@europeanyachtbrokers.com for the latest information.

Broker tip: Agree who submits and tracks the request. Retain submission evidence and copies of the handed-over documents, and establish a separate route for flag changes. See also our guide on how to register a boat in Portugal.

Section 4

Which costs and tax assumptions should be avoided?

DGRM states that its simple ownership-transfer service has no cost, while noting possible local maritime-authority charges for altering registration. As a practical recommendation, obtain the local charge for the actual request and keep it separate from the intermediary's fee and any professional advice. This is not evidence that an overseas seller's entire transaction is free. The boat's current registration, additional changes and other services can affect the work that must be priced and allocated.

The Civil Code's sale rules provide a default for contract and ancillary expenses unless the parties agree otherwise. As a practical recommendation, state the intended allocation in the sale documents and list separately authorised charges. Ask who pays for preparation, inspection access and the documents needed for completion. Avoid an unexplained deduction from the sale proceeds. A clear account lets the seller abroad compare the agreed terms with invoices and identify what the representative has paid on the seller's instructions.

Portuguese VAT law addresses supplies made for consideration by a taxable person acting as such, imports and regulated intra-EU transactions. Those categories do not produce an automatic exemption merely because the seller lives abroad. As a practical recommendation, give the tax adviser the ownership, seller-capacity and movement history before asking for a conclusion. No personal capital-gains result, customs permission to sell under temporary admission or guaranteed tax-free outcome is verified here. Those questions belong to the actual transaction's official tax and customs assessment.

Broker tip: Get a case-specific cost allocation and final account. Have tax and customs status reviewed from the boat's documents and movement history, without assuming residency supplies an exemption. Readers often go on to our guide on what it costs to sell a boat in Portugal.

Your questions

Frequently asked questions

Can the paperwork recognise an owner living abroad?

Yes. Article 17 of the Portuguese recreational-registration regime expressly addresses an individual owner resident outside Portugal and requires proof of address with the specified identity and tax details. It also addresses equivalent company evidence for entities registered abroad. Confirm that this regime is the correct route for the actual boat rather than assuming location alone determines the registration procedure. [Diário da República]

Can I use a representative while I am overseas?

A representative can be given powers, but the document and scope need to fit the intended acts. Civil Code Article 262 defines the power of attorney and addresses its form. As a practical recommendation, have the signing and payment powers reviewed locally and provide evidence to the other party. Permission to arrange access should not be assumed to cover every commitment in the sale. [Procuradoria-Geral Distrital de Lisboa]

Who applies for DGRM's ownership-transfer service?

The future owner or that owner's legal representative applies. DGRM describes BMar submission and lists the boat document still in the seller's name and evidence of acquisition. As a practical recommendation, agree who prepares and follows the request and how copies and submission evidence reach the overseas seller. Check separately if the sale also involves other changes or a foreign registration. [DGRM]

Is the whole transfer free?

DGRM's stated no-cost position concerns its simple ownership-transfer service and expressly notes possible local maritime-authority registration charges. It is not a full sale-cost total. As a practical recommendation, price the actual local procedure and any professional or intermediary services separately, then record who pays each charge in the agreement and completion account. No universal all-inclusive figure was verified. [DGRM]

Does non-residence make the sale tax free?

No automatic exemption based solely on living abroad is established by the sources used here. VAT Code Article 1 addresses several categories of taxable operations. The actual seller capacity, boat history and movement route need examination. Obtain a case-specific official tax or qualified-adviser assessment, particularly where customs or temporary-admission status is unresolved, before advertising a guaranteed tax-free outcome to the buyer. [Autoridade Tributária e Aduaneira]
